If the 5 minute window exists...it is because McConnell and Ryan want it to exist......and then claim innocence....”That Darn Obama! He took advantage of that Darn 5 Minute Window....”.....never mind that they could have stayed in session...effectively overlapping that window in order to close it......More of same.

Obama WILL DO IT! What does he have to lose at this point???

A recess appointment would end the minute that the Senate confirms his replacement. Roberts would remain the chief justice. Roberts would have to allow the court to hear AND rule on cases ... usually actions that happen months apart ... in the interim. The Senate could likely respond with abolishing the filibuster for SCOTUS nominees, if not entirely.

Final result:

An embittered chief justice
No new liberal rulings
End of the fillibuster
An enormous failure for Obama, which would end up encapsulating his entire presidency

If Obama does it, he’s a fool. If not for the permanent damage to collegiality and the institutions of government, I’d say, “make my day.”

I was leaving that part out. I think no ethical man would want to be a party to that kind of gottcha. I was thinking that when the music stops he will be the one without a chair having given up his post for a one year contested appointment and dependent on the irate conservatives for his next judgeship when that interim post is over.

I have no doubt Mitch’s wife was appointed to get Mitch on board but I also no faith Mitch would act strategically and keep Obama from doing this. Obama won’t want to trade a temp SC justice for a lifetime DC Court position and that is what may keep him from doing it. I say the odds are 50/50 because he may take his chances that Graham, McCain and perhaps others will clog things up and keep Trump from exacting revenge.

I read a very detailed & credible article on this when it first came up that someone had this bright idea Obama could recess appoint Merrick. Per the article, it’s a non-starter. Can’t happen the way they say it could. I didn’t save the article, but if I can find the link, I’ll post it.

Most reasonable thinking people would understand your points. However, Democrats are vicious infighters and to them politics is blood sport. They are quite capable of being vindictive, even at the expense of severe political repercussions and self-inflicted wounds.

Since losing big in recent years what did they do? They lunged further to the left. I don’t want to even speculate on what they might do with Garland on the USSC, albeit for a temporary period.
