Former Disney IT Workers Claim Discrimination In Lawsuit

A group of information technology workers laid off by Walt Disney Parks and Resorts claims they were victims of discrimination.

The say they were forced to train their replacements from India before they were fired.

On Monday, the 30 former IT workers filed a suit against the company in an Orlando federal court. They’re seeking punitive damages.

The lawsuit contends that 250 IT workers in Florida were told they would need to train their replacements before they were fired at the end of 2014. Each replacement worker was of Indian origin, and was either brought from overseas or working outside the United States, according to the lawsuit.

The lawsuit also alleges violations of the Older Worker Benefit Protection Act, which protects workers from age discrimination.

Disney managers were “being curt and unprofessional toward plaintiffs but treating the foreign replacements with special treatment,” the lawsuit said. “Plaintiffs were subjected to disparate treatment by defendant solely based on race or color and ancestry.”

Disney said in a statement, “Like the two other dismissed cases brought by this lawyer, this latest lawsuit is nonsense and we will defend it vigorously.”

Disney says the jobs were no longer needed....

Okay then why are they training anyone if the job is no longer needed?

I guess Disney is saying Information Technology is going away?

Okay then why are they training anyone if the job is no longer needed?

Disney had outsourced its IT functions to a third party vendor so strictly speaking those jobs were no longer needed by Disney. The Disney people were training the vendor's people. It's a complete violation of the original purpose of H-1B visas but it isn't illegal.

Until AG Sessions picks this up and Files Criminal Charges against these Companies Board of Directors and Executives, these Civil Suits will go nowhere.

Disney probably broke a lot of H1B laws as well which the current Justice Department would ignore. What I’ve seen is give an inch with a law and they take a mile going far beyond what the law actually says they do.

I live near a large apartment complex that's just chock full of H1B types....just about every one of whom appears to be from India/Pakistan/Sri Lanka.Probably IT.I talked to one once at a bus stop.He said he was on a 1 year visa and would be going home soon.He said he was an "engineer" but didn't specify what kind.

I hope that DJT puts a stop to this.Americans losing their jobs to Third World people is despicable...even when the replacements are here legally.

If they are training their replacements then H1B visas are involved. Thanks to the congress these got increased.

This was going on during election Trump noticed it

I hope that DJT puts a stop to this.Americans losing their jobs to Third World people is despicable...even when the replacements are here legally.

Trump met yesterday with the leaders of major tech firms. I doubt that any H-1B restrictions were mentioned, or that they would have gone over very well if they had been.

Disney held their severance package hostage to a successful turnover. Either train them or lose your severance and unemployment.

Take a look at the photos of that meeting. Jeff Bezos’ face had a look like someone had just crammed a pineapple up his ass.

Trump surely said SOMETHING that did not go down well.

The unfortunate fact of the matter is that Disney broke nothing. They didn't hire any H-1Bs to replace their people. They outsourced that function to a company that did hire them. And having outsourced the functions then they didn't need the American employees. This has been going on for decades in corporations all over the U.S. And nothing has ever been done to stop it.

I see, well maybe there is still some way to charge them for skirting the law or at least now I have hope for the future to close this loophole.

It is a variation of the “they aren’t employees they are are contractors” game that Microsoft played and lost.

Probably what will happen here, under obozo or Trump.
