Just came across wires.... recount stopped by state appeals court!
The judge did not force anyone to do anything. I doubt the state can make anyone count ballots against their will.
This was obvious, her own legal team was telling her this. This was never about winning an election, that ship has sailed and is halfway to The Orient. This recount effort was just something to get the troops out of their basements and back on the streets fired up.
There’s also a federal case. The state case just got stopped. Will the ICC get involved next?
Yes the judge is exceeding his authority. They are proceeding at the threat of being jailed, correct?
We are at a time where we need to not be so intimidated over threats of jail when they are clearly in the wrong and overstepping their authority.
Fear of jail and lawsuits is how we have arrived at the age of judicial tyranny.
You are assuming people who abide by normal rules of jurisprudence. On the other hand, these folks are the same people who found "a right to privacy" in the U.S. Constitution and twisted that into the right to kill babies who had the unfortunate circumstance of not yet being born.
Yes, "No one has made that argument". Yet, we both know that there is a high probability that someone will. And at that point, "prove" becomes a wax nose (to use a figure of speech from theological terminology).
Wait, WHO’S ON FIRST? I DONT KNOW. THIRD BASE!!
I think I read somewhere that the difference between them in Michigan is only about 10,000 votes.
I’m impressed with Schuette too.
My brother says the next GOP primary for governor will be Schuette vs. Calley (Calley refused to support Trump).
I’m for that. I see it (electoral/voter fraud) as being at least an obstruction of justice.
We get it. You have a judge who may not respect the law. If he continues to hold Michigan hostage, is impeachment the only solution?
Michigan needs to start collecting documentation on this “judge”.
Thanks for your work. See post #304
Yes, thank you!!! The dissenting 6th circuit judge made it quite clear that Goldsmith went way above and beyond to punish the state of Michigan, presumably for voting Trump.
Many here are acting like this judge wants to do the right thing. Guess again.
"...even though a temporary restraining order is an extraordinary remedy designed for the limited purpose of preserving the status quo pending further proceedings on the merits, the district court peremptorily intervened to disrupt the status quo. And the court did so on the thinnest of legal foundationsbased on a speculative showing of harm and undefined showing of legal entitlement to relief."
"a district judge has seen fit to deploy the judicial power of the federal sovereign to intrude upon proceedings under state law that are traditionally entrusted to the states . . . simply because he thinks, in regard to a statutory two-day period (!), that he has a better idea than the elected representatives of the people of the State of Michigan . . . and because he can"
"By ordering continuation and completion of the recount by December 13, the court purported to assert power in excess even of the authority it had illegitimately claimed for itself. This overreach should be seen for what it is: a naked and illegitimate power grab that should stand as no impediment to the state courts orderly adjudication of the state law issues before them in accordance with state law."
"By issuing the temporary restraining order, the district court abused its discretion. By refusing to stay this judicial overreach, the majority perpetuates, and lends the Sixth Circuits imprimatur to, modern confusion surrounding the federal courts limited oversight of state election processes. I respectfully dissent."
Steins Lawyers will argue that they havent exhausted their legal remedies in MI,
**********************************************************
After the MI Supreme Court there ARE no other remedies in MI.
He also said that the recount should continue until his court said otherwise. Arrogant jerk
************************************************************
Arrogant? Sure but what he means (I think) is that since he is the one who ordered the recount to start, he should be the one to order it stopped.
Like watching the Packers play the Eagles

Easy one for me. As a NYG fan it’s “GO PACK!!!”
Thank you for including these quotations from the 6th Circuit dissent.
Unfortunately, it indirectly proves my point. I believe the most of us on this forum would agree with the arguments on this dissent stating that Goldsmith injected himself into what is inherently a state issue.
However, if this is the dissenting opinion, then the majority of the 6th Circuit justices do not agree and were willing to let Goldsmith contravene state law in the matter of the recount delay. If they were willing to allow that level of injection, then they will probably be willing to inject themselves, later.
Yes!! Sigh. They let it go and now they will let him go again. Mark my words. He will issue later today to keep the recount in place and all of ypu living in some mythical paradise where the rule of law matters will then say oh now xXxX will fix it.
But we will still be recounting.
My point is that none of pur beliefs matter. That has always been my point. This jacka** judge will do whar he wants.
I prefer one from Column B.
