Indeed, if his is a publicly traded company then he has a fiduciary responsibility to the shareholders to legally maximize profits to the best of his ability. To deliberately drive away business for ANY reason (except and unless a legal point is involved) does open him up to charges of a dereliction of those fiduciary responsibilities.
