Let’s see what happens then.

Can anybody say, “jail overcrowding”? At that point, it should be the government that pays for the added costs of jails and prisons and additional staff for jails/prisons and courts.

Nonsense. The general purpose of bail is to assure the suspect returns to court for his/her trial. The greater their wealth, the greater the cost of fleeing the court’s order to appear. The less likely the chance of disobeying, the lower the cost. The more questionable the charges, the less the probability of not returning, hence the lower the bail. If you’re too poor to pay the bondsman, the room and board is free. Maybe that’s too simple, but it has worked for a long time.

It’s called “Court is now optional, and so is obeying the law”.

There is law firm here in the St. Louis Metro suing municipalities for jailing people. The law firm says it was because they were poor. The municipalities say its because they refuse to come to court to plea their case or work out some type of payment plan. We are talking years of failures to appears and tens of thousands of cases.

Now its nationwide? Oh boy...

SCHR files lawsuit against city of Calhoun

Walker was arrested on September 3, 2015 for the charge of ' Pedestrian Under the Influence.' (I have issues with that charge, but that is for another thread.) Because it was the Labor Day weekend, he would not be able to appear before a judge until September 9.

In that context, it's of 6 of one, 1/2 dozen of another. No cash bond system, Walker and every other person arrested for minor offenses would sit in jail until the next scheduled court date.

What is not mentioned in the NBC article is that Walker is schizophrenic (according to his attorney). If true:

Did he sober up after time had passed? Was he lucid? Was he able to answer questions appropriately? Did he exhibit behavior indicating he was able to care for himself? Would he go back to wandering the streets in the same state he was in at the time of his arrest? If he was released while exhibiting behavior consistent with schizophrenia and something happened, what then? A lawsuit against the city for negligence?

Did he have family willing to come to the jail and pay the bond? If he had family who refused to pay the bond was it because at least they knew where he was and that he was safe while he was in jail.

The questions are relevant because the courts are being used to throw the baby out with the bath water. Again. Destroy the system instead of fixing the problems.

It is not Constitutional then to hold anyone. Some people should not have to pay bail when others do not have to pay bail.

This Dept of Justice is a joke.

Isn’t the true problem the snails pace of the court system and the lack of speedy trials after arraignment? If a man is arrested on Saturday, there should be no reason why he shouldn’t be tried and convicted by the next Saturday. That way you don’t need bail unless it is to plan for your life behind bars after conviction. If a case can’t be made for your guilt or innocence in a week, screw you. Of course this assumes that ONLY actual crimes against someone will be brought. No more amorphous “State is preferring charges”. Either someone was harmed and can prove it, or don’t waste the courts time.
