He should appeal to have it set aside.

Selective enforcement.

Laws that aren’t enforced become null.

Comey set a precedent here that’ll let everyone who violates these laws walk.

Didn’t Clinton knowingly, willingly, and with intent set up her server to avoid the oversight

That's exactly the way I see it.

When I was active Duty we had a contractor inadvertently load a classified data tape on one of our test systems. The data never left our enclave (that we know of) and the error was discovered within hours of being loaded.

The contractor was immediately fired, fined heavily, lost his clearance and was forbidden from ever working for the Federal Government again.

As security officer I got the joy of sitting with OSI and going through every single one of our systems - FILE BY FILE - to clean them. We were allowed to remove "cleared files" to back up media, and once we were done with a server it was wiped using DoD software and then the HDs were removed and destroyed. Three months of my life I will never get back.

“To be clear this is not to suggest that in similar circumstances a person who engaged in this activity would face no consequences. To the contrary those individuals are often subject to security or administrative sanctions but that’s not what we’re deciding here.“

A year ago, a Folsom Naval Reservist was Sentenced After Pleading Guilty to what Crooked Clinton walked away from, see comments above from Comey.

SACRAMENTO, CA—Bryan H. Nishimura, 50, of Folsom, pleaded guilty today to unauthorized removal and retention of classified materials.

U.S. Magistrate Judge Kendall J. Newman immediately sentenced Nishimura to two years of probation, a $7,500 fine, and forfeiture of personal media containing classified materials. Nishimura was further ordered to surrender any currently held security clearance and to never again seek such a clearance.

Nishimura was a Naval reservist deployed in Afghanistan in 2007 and 2008. In his role as a Regional Engineer for the U.S. military in Afghanistan, Nishimura had access to classified briefings and digital records that could only be retained and viewed on authorized government computers.

Nishimura, however, caused the materials to be downloaded and stored on his personal, unclassified electronic devices and storage media. He carried such classified materials on his unauthorized media when he traveled off-base in Afghanistan and, ultimately, carried those materials back to the United States at the end of his deployment.

In the United States, Nishimura continued to maintain the information on unclassified systems in unauthorized locations, and copied the materials onto at least one additional unauthorized and unclassified system.

Nishimura’s actions came to light in early 2012, when he admitted to Naval personnel that he had handled classified materials inappropriately. Nishimura later admitted that, , he destroyed a large quantity of classified materials he had maintained in his home. Despite that, when the Federal Bureau of Investigation searched Nishimura’s home in May 2012, agents recovered numerous classified materials in digital and hard copy forms.

The investigation did not reveal evidence that Nishimura intended to distribute classified information to unauthorized personnel.

This case was the product of an investigation by the Naval Criminal Investigative Service (NCIS) and the Federal Bureau of Investigation. Assistant United States Attorney Jean M. Hobler prosecuted the case.

The investigation did not reveal evidence that Nishimura
(intended to distribute classified information to unauthorized personnel.) So Nishimura’s lawyers will be going to a federal court to get his sentence reversed and multi million $’s in damages due to this abortion of justice for Clinton.

Some one needs to re-post the article about the military guy who used a personal laptop to send a warning to command about an impending attack. He was court martialed or prosecuted for sending classified information over non-classified system even though his actions saved the day.

Even without his recommendation for prosecution, doesn’t the Just Us Department have it within their power to still go after her?

I know they won’t with the current cretins running the show, but thinking about after Trump’s inauguration when he has a real AG in place and asks Comey to hand in his resignation.

An excellent example of how the military takes classified material very seriously while Hillary could care less and lies her rear end off over what she did.

She had the intent to thwart Freedom on Information laws.

EXACTLY! There was intent in her own words that she wanted to avoid FOI investigations. But Comey ignored it. Not that intent was needed apparently. I thought he was a good guy...now he's another John Roberts.

Suppose Clinton never had a shred of classified material on her email server.

She’d still be criminally responsible for conducting federal business on private systems where her records of activity would be hidden from search and recall.

It’s my understanding Justice does have the authority to indict her no matter what the FBI recommends but don’t know about in the next administration, the commie libs would be screaming like a three year old having a tantrum if the Trump administration did. :)

None of this matters to the Liberals because crime in the pursuit of their causes is a good thing.

” Illustrating that FBI Director James Comey is a liar and a fraud,”

” he acknowledged the importance of not granting special treatment to a rich and famous person. “

conclusion : Douchebag 1st Class - subverted minion peon to the Obama Alinskyite regime .
