FBI Rewrites Federal Law to Let Hillary Off the Hook
National Review Online ^ | July 5, 2016 | Andrew McCarthy

Posted on 07/05/2016 10:22:00 AM PDT by Mariner

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

Yet, Director Comey recommended against prosecution of the law violations he clearly found on the ground that there was no intent to harm the United States.

In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute, inserting an intent element that Congress did not require. The added intent element, moreover, makes no sense: The point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to safeguard national defense secrets; when they fail to carry out that obligation due to gross negligence, they are guilty of serious wrongdoing. The lack of intent to harm our country is irrelevant. People never intend the bad things that happen due to gross negligence.

Will these bastards - and yes I include Her Heinous in that epithet - ever be held accountable for anything? Ever?

God be in your dread.

It is time. Something has to give. Our population is fundamentally transformed already and increasingly so with every tick on the clock. We are running out of time to reclaim our bearings. Thx, dear DV.

It seems to me that this is what the FBI has done today. It has told the public that because Mrs. Clinton did not have intent to harm the United States we should not prosecute her on a felony that does not require proof of intent to harm the United States. Meanwhile, although there may have been profound harm to national security caused by her grossly negligent mishandling of classified information, we’ve decided she shouldn’t be prosecuted for grossly negligent mishandling of classified information.

Hillary’s Presidential Campaign is now a criminal defense strategy.

What bothers me, is that the FBI did not see Hillary getting anything. But she is a politician. Being President is her life’s ambition. She has given up everything for that. And its clear that she risked US security over her own ambitions. To her, receiving an envelope of money is not nearly as desirable as hiding her emails from the public.

Interesting dig on Hellary during his press statement. Comey said any reasonable person should know.

So Hellary is not reasonable? That’s the only takeaway I see from that.

Doesn’t intent come later during sentencing? Intent wasn’t for Comey to decide.

I wonder if Comey and Lynch will take the same plane to Malta to pick up their Swiss bank accounts?

Not as long as the party of loyal opposition is nothing but a bowl full of bleached turds.

"Who will have the cojones to prosecute the extremely guilty Hillary?"

President Trump's AG. Obama would have to pardon her otherwise to have a future himself. This is his out. Wait a year, timing is everything.

Comey fell on the sword for very powerful politicians. He will be richly rewarded in either a Hillary administration or the Obama For America foundation. This country is toast. The only thing to do now is figure out how to live in relative obscurity and still make a good living. I’m too young to sell the business and retire but too old to start over in a safe politically connected job. It all comes down to what the Berners do now. Do they vote Trump in enough numbers to make up for the illegal votes that will go to Hillary. Will it be so massive that even the electoral college will be forced to vote for Trump? What dirt do the Clintonistas and Obamanunists have on the electors?

I’m not going to NR to read the rest but does anything else even matter?

Even better, I think is to go with the "knowingly removes" statute. 18 USC 1924(a). Indictment of Bryan H. Nishimura

A 9 figure bribe from the Clinton Global Initiative would be a great way for Baraq to begin his retirement....

It’s LYNCH, not Comey, making this decision!

Comey said she’s prosecutable.

Lynch said SHE won’t prosecute - SHE DECIDES, not Comey!

Sheesh!

This was a deliberate ,intentional avoidance and distortion of 18 USC 793f to tell the American people a lie that “Intent” was required when it absolutely was NOT!! Gross negligence DOES NOT REQUIRE “INTENT”. Comey is directly responsible for this lie to the American people. Do not let the media or any body else argue there was “no intent” . “Intent” was and is not required . If she was Grossly Negligent- that does not requite the intent!! We were lied to by by the Director of the FBI today to spring hillary from jail . We are in a national and constitutional crisis.

Trump can motivate the voters by offering to prosecute Hillary as soon as he is elected. Take that fat @$$ Hillary! :-)

Nope, sadly there is precedent for pardoning before being accused or indicted (ford to Nixon).

"8 USC § 793(f)" Trump should cite this statute every time he communicates with the public, via any means.

I agree. It would be more effective than "very very unfair"
