Let me just say that the investigative arm of the Federal government rarely, if ever makes recommendations on the evidence. This role is left to Justice Department lawyers who should be working as a team with the FBI agents to develop the case. The agents provide the evidence, the Justice lawyers analyze and make recommendations. If a Grand Jury has not been involved in this investigation yet, then seating a Grand Jury is the next decision that needs to be made in the criminal process.
