The Justice Department announced Tuesday that it will not seek the death penalty against Ahmed Abu Khattala, 54, a U.S.-designated terrorist whom prosecutors accuse of leading the 2012 attacks in Benghazi, Libya, that killed four Americans.
The announcement, contained in a notice to the federal trial court in Washington, clears the way for a major terrorism trial in the nation’s capital, the first in the U.S. since 2015, barring a plea agreement by Abu Khattala.
The decision ended a lengthy review after President Obama aired concerns in October that while he supported capital punishment in theory, he found it “deeply troubling” in practice.

I have my doubts that Timothy McVeigh conducted the OK City attack.
1. McVeigh came into custody because he was driving an unregistered vehicle and he not only did not have a driver’s license, as a Constitutionalist he had NEVER had a driver’s license.
2. Yet he supposedly rented a Ryder truck in his own name.
Uh-huh.
One of these two things is wrong. I’m going with what’s behind door #2.
Unless, of course he gets to play virtual reality with Predator drones carrying Hellfire missiles. Watching those vehicles go BOOM on the flat screen must be a pretty heady experience, after all. As he admitted when asked about that, said "I'm getting pretty good at killing people".
But giving a terrorist the death penalty for attacking an embassy? Nah...
