A Houston lawyer contends that all criminal charges have been automatically dropped against a Brenham couple and nearly 40 other bikers who were arrested following the deadly May melee at the Twin Peaks in Waco. They were not indicted as of midnight Thursday, the deadline for grand jury to have completed its work, he said.
"It timed out," said Paul Looney, who represents Morgan and William English, who were arrested for allegedly engaging in organized criminal activity and originally were held on $1 million bail each, as were all others in the case. "Pop the champagne."
Looney, who was speaking as he headed back from Waco, where he said he met behind closed doors Friday morning with McLennan County District Attorney Abel Reyna, first assistant prosecutor Michael Jarrett and State District Judge Matt Johnson.
Prosecutors could not immediately be reached for comment.
Exactly how many people have their charges dismissed is unclear At least 148 people have been indicted over the incident. At least 177 were originally arrested following the clash that left nine dead and two dozen wounded.

Looney said they all agreed the judge would have had to sign an order extending the term of the grand jury, which already had been extended an additional 90 days, but that no request had been made.

Broden was in court today seeking a change of venue for one of his clients. I believe it was denied. But, he got Swanton on the stand.
Justice in America: the prosecution can charge you and put you through the process, and then just walk away.
(But meanwhile, you have been harmed, paid out huge sums, had your reputation wrecked, etc.)
I’m guessing there may be a few lawsuits coming up...
What a cynical Kabuki play
Denis Michael lynch last night on Newsmax had the bikers ride to DC for pro life. Part 2 tonight. The bikers were awesome!
Wow, guess will see how this shakes out, lots of lives have been put on hold.
Will the day ever come when these prosecutors actually have to produce some evidence in open court?
TG deeply saddened.
More to the point, will the day ever come when state attorneys and prosecutors are required to accept personal responsibility for abuse of authority.
Fixed it.
I can agree with that, thanks for correction
Mr. and Mrs. English should not be elated. They should be outraged that their lives were torn apart by a rogue prosecutor who had no evidence in hand excepting that they were at the Twin Peaks restaurant when a crime occurred.
And, oh by the way, who murdered the victims at Twin Peaks, the world is waiting to learn?
Glad to be of assistance :-)
If you look closer you will see the Bikers on the Pro-Life ride were very different than the criminal Bandidos, Cossacks and “support” gangs in attendance when they shot up the Waco restaurant.

Loss of employment, financial hardship
Did some people get killed by 5.56/.223 rounds that were not armed and just standing in the wrong place?
Just watch. In a couple of years 3 or 4 bikers will make a plea deal for a suspended sentence and the rest will walk.
About time. Not that Waco cares these poor people have had their lives and their families’ lives totally ruined by those bogus charges. May the prosecution and LE rot for what they’ve done.
Swanton will perjure himself with all his lies. That’s the one who needs to be behind bars.
