The photo of Trump’s wife was published in the magazine GQ years ago and has been in the public domain. For the Super PAC to use the photo, they had to pay for the rights to the photo.
There are legal uses for a copy righted picture online if it falls under the fair use section. However a PAC is a professional operation and there is no fair use for professional use.
So even if you or I used it and commented on it, it would not be legal for the PAC to use it in an ad where money is paid such as advertising dollars and donations.
Thats why they had to buy the license to the copyrighted photos and its the CSI type fingerprint that proves Cruz is lying when he claims he had nothing to with it.
