Burns, OR - An FBI agent is suspected of lying about firing twice at Robert "LaVoy" Finicum and may have gotten help from four other FBI agents in covering up afterward, authorities revealed Tuesday.
The bullets didn't hit Finicum and didn't contribute to his death, but now all five unnamed agents, part of an elite national unit, are under criminal investigation by the U.S. Justice Department. Inspector General Michael Horowitz is leading the independent inquiry.
The remarkable disclosure came as a team of local investigators released findings that two state troopers shot Finicum three times in the back during the chaotic scene at a police roadblock Jan. 26. One bullet pierced his heart, an autopsy showed.
A prosecutor ruled the fatal shooting was legally justified, saying state law allows use of deadly force when officers believe a person is about to seriously injure or kill someone. Finicum kept moving his hands toward a pocket that contained a loaded handgun. Although he was shot from behind, Finicum had a trooper in front of him armed with a Taser who was thought to be in danger.
Finicum, 54, an Arizona rancher, was one of the leaders of the Jan. 2 takeover of the Malheur National Wildlife Refuge near Burns.
Investigators gave no details to explain why the one FBI agent, a member of the Hostage Rescue Team, wouldn't report the two shots. They also didn't indicate what his four colleagues on the team did to warrant investigation other than saying it was related to conduct after the shooting.
He was shot on his side and then his hands dropped, that was the excuse the fedgov maintains why they shot him, but he was shot before his hands dropped. Also he never had a 9mm gun, he carried a revolver .45 colt. The gun they “planted” on him was a stolen gun. People can say many things about Lavoy Finicum, but what you can’t say is he is a thief, ie. he would never have a stolen gun.
remember the mayor or governor told the feds they wanted this brought to an end after weeks at the refuge. So there might be a case that person is also partly responsible with their orders.

I’ll add that he was clearly tazed before ‘reaching for his gun’. What a crock. Anyone who is tazed will drop their arms because their muscles convulse. They’re using that as the pretext for shooting him. It is ridiculous. He was incapacitated and couldn’t reach for anything.

Fleeing from an arrest is, however, and when you are known to be armed and make a furtive move, you will be shot.

The shot that went into the roof was while the truck was approaching the barricade, before he swerved into the snow bank on the left.
At 5:22 you hear the first shot hitting the cab and Finicum says "hang on" and then the girl says "they're shooting", followed by the sound of the second shot hitting the cab.
These officers who are all on the pavement and behind the vehicles realize that at his rate of speed he will not be able to stop.
The first two officers abandon their position and move into the snow bank on the right side of the road
By 5:25 the third officer is moving into the snow on the left side just as Finicum is swerving to the left. If the snow had not stopped the truck, the third officer would have been run over.

It certainly appears that way. The cops had an ambush site picked out, fortified, ready and waiting with about a dozen shooters situated just off the road hiding in the trees. They are probably responsible for jamming the cell service at the ambush site as well.
The way it appears was that they’d attempt to pull the vehicles over before they reached the ambush site. If indeed at the original traffic stop the cops fired on them, then it is abundantly clear the intent was to scare and force them into the ambush site, where they probably figured LaVoy and others would come out of their vehicles with guns blazing, giving plenty of justification in the public eye for killing them all. The problem was that nobody in the pickup started shooting! The people at the ambush didn’t really know what to do because things didn’t go as they planned. The best they had, and have, is that LaVoy DID exit the pickup (drawing attention on himself and away from the others in the truck) but as he was plodding through the deep snow, NO guns visible on him, he didn’t obey their commands to lay down, if any commands to do that were even issued. That’s the BEST excuse they have for opening fire on all of them: failure to play Simon Sez with the cops.
But again, the place where the pickup truck went off the road was clearly set up as an ambush site, and quite possibly as a kill zone. The biggest question that remains is was the first place that they were pulled over meant to be a genuine attempt to bring them all into custody, or was that first stop meant to scare them all, hoping they’d flee into the ambush site where they’d be met with overwhelming firepower by guys fully expecting ‘those crazy ranchers’ to start shooting as soon as they stopped.
Some would say a self-fulfilling prophecy.
What is most striking about the audio is that while they are stopped and Finicum is refusing to get out, numerous times questions are asked as to where Ammon and Ryan are or what Ammon and Ryan are doing.
Even though their vision of Ammon and Ryan is blocked, it is sinking in that both Ammon and Ryan had gotten out of their truck and were offering no resistance.
If Finicum wanted to go down in a hail of bullets, that was his choice, but he should have told the passengers/women to get out before he drove away.

Deliberately selecting a cell deprived area is a snap, so is inadvertently selecting one. We'll probably never know whether it was intentional or luck of the draw.

You either go all in or not at all. I'm not advocating one way or the other, but common sense tells ya that if a person puts them self up against the gubbamint, there are only two outcomes.
Folks may believe there are three, but not so. You either stand and fight or go to prison. The feds are not going to bow to anyone. The feds are not going to simply say, “oh, nice try boyz, lay down your weapons and get on back home”.
Not gonna happen. Civil disobedience is one thing, armed civil disobedience is quite another.
And Finicum said “you’ll have to shoot me” as he’s getting out of the truck and keeps repeating that until he does get shot.
Yes and since it’s illegal to say that even with your hands raised, they can shoot you 3 times in the back. /s
True, but following that erratic behavior by jumping out of the truck, refusing commands to surrender and reaching inside his jacket was sure to be viewed as a threat by the LEOs, and I suspect that’s what LaVoy wanted.

All I could hear on the video shot from inside the truck was Lavoy repeatedly telling the LEO’s that they would have to shoot him, as he left the truck and up until the time they shot him.
