So this government headed by an angry, gay, muzzlim is just trying to protect us? Oh, and they get help from the big grey building in Utah, right? No way. A crack staff including Mitnick could crack it and write the software themselves but they are forcing the corporation to do it? Why? Because they turn a profit and they want to know all metadata about everything phone user. Next, hello T-Mobile, AT&T, Verizon...Gubmnt needs your help...oh, and you don’t have a choice. No worries...you’re fine if you haven’t committed a crime, right?
No, but technology will enable them to do that and there's nothing we can do about it. If Apple doesn't provide the unbreakable encryption, then China will provide it except theirs will have a back door just for their use.
You might want to step back and remember who is considered a potential terrorist in the eyes of DHS.
Of course a “Maverick DHS Office” was blamed for that report, but it stands on its own in the years since 2009.
Thanks.
HI SteveH,
Thank you for posting this. I’ve thought for some time that since the Thirteenth was the result of a war, we should pay special attention to it. The government has the phone. It can have its way with it. If it doesn’t have the technical expertise to handle the res, they can not conscript another without consent.
I can foresee, if permitted, Apple providing the required work, and becoming deeply involved providing witnesses in any criminal prosecution. Does Apple become a de facto arm of the government?

“I don’t doubt there is a provision in there somewhere to force innocent private individuals or corporations to do things against their will.”
A contractor can be compelled to accept and complete a contract action under certain circumstances. Contracting officers are very reluctant to impose this but it can be done. The government is liable for any reasonable expenses incurred. I’ve seen it done. Very rarely but it happens.
And what was the military draft but involuntary servitude?
Forcing someone to fight or be punished by incarceration or death sure meets any logical test of “involuntary servitude”.
The existence of a drafted army tempts politicians to use it.
They can’t stop a million illegals crossing the border a year or profile Muslims cheerleading ISIS online, but being able to read any electronic medium at any time will make us safer?
“The US Government could âseizeâ the whole Apple operation for impeding the âwar effortâ.”
What war effort? We don’t have a declared war. This is the same old warmed over bullshit I’ve seen since I signed on to FR. There’s always someone who thinks anyone who isn’t a total Cuck for the government is a traitor and guilty of a thousand crimes. Left over Neo-con crap from years ago.
I do not disagree with you. However, the answer does not mean private citizens are required by either courts or legislation to carry the government's burden. It is the antithesis of the principles upon which this nation was founded. The Constitution limits the power of the government, not citizens.
There is no need for the government to have access to every iPhone in this country. I know, they need a warrant, but the warrant is meaningless because more often than not no one will ever know the data on their phone was searched & harvested. No chance for the subject to "lawyer up." A prosecutors dream.
If LEO wants the data they can do it the old fashioned way. Get a warrant and seize the phone. If the owner refuses to give the passcode, get a court order. If the owner still refuses, jail him for contempt.
All this controversy concerning iPhones and encryption.
What about Android phones? Are they encrypted/ breakable?
Apple is behaving no differently than Jane Fonda and her anti-aircraft gun.
Hanoi Jane doesn’t have the brain cells to build an anti-aircraft gun. Nor did she build a weapon to protect the USA. In contrast Apple is protecting the USA by protecting its citizens.
Humm and a few days later San Bernardino happens along with the fall out.
“You donât get to create the danger, and then tell me what I must do to help you protect me from the danger you are still creating.
That is straight Mafia.”
Winner!
What color dress was hoover wearing the first time you saw him/
Hoover was fired by Bobby Kennedy, John tried also, then LBJ fired him. When did he leave? Oh I remember when he died he left office. Something kept him in power.
Reading the filing: with the data on the cloud, the data is not self destructed (as it is on the phone) if too many attempts at guessing the password are made. Also attempts can be made extremely quickly.
Don’t need a password since you get infinite attempts at high speed.
That is why the govt, in the filing, is demanding that Apple create a back channel around the self destruct and attempt delay on the phone. i.e. infiite attempts at high speed
The govt evidence tampering (that prevented getting the data onto the Cloud) was discovered when Apple was in the process of providing the data voluntarily from the Cloud.
It’s not too difficult to read the filing despite the legalese.
“Iâm an old fashioned America patriot.”
Actually I think you’re an old fashioned fool.
The FedGov ain’t being run by Thomas Jefferson these days.
