I don’t think this would go through the federal courts if it’s an administrative case regarding placement on a state ballot.
One of the issues we had to deal with in drafting Nebraska’s Eligibility Bill was how to have a state law that would end up providing a case with standing in the federal courts.
I don’t believe administrative procedures involve the state as a legal party in an actual lawsuit, so it’s not appealable to the federal judiciary. If a state decided to keep Cruz off the ballot he would have to sue to have it on the ballot, and that could be under federal jurisdiction since the state would be a party in the suit. But that would not be the best route for having this decided. The best route would be Trump suing Cruz, because they could work together to expose the 2008 coup.
” to expose the 2008 coup”
Bingo! that is always my belief that is what they are doing, just ignore the Kabuki Theater that Donald and Ted are performing. It would also be interesting to see if this case about Ted comes across any of the judges that also looked on Obama’s case.
