With the Republican primary in South Carolina just days away, Ted Cruz has stepped up his fight with Donald Trump, who is threatening to sue him unless he stops airing what the billionaire candidate calls "false ads" and retracts what he called a series of lies.
Cruz questioned both Trump's conservative credentials and whether he had the temperament to be president.
"The people of South Carolina want a consistent conservative they can trust," Cruz told reporters before his rally in Aiken.
Cruz, who is trying to weaken Trump's standing among South Carolina's social conservatives and evangelical Christians, also released a new television ad attacking Trump, showing footage of him praising Planned Parenthood and Hillary Clinton. It ends with the line, "South Carolina cannot trust Donald Trump."
Trump is challenging Cruz's eligibility to serve in the White House, calling him "the most dishonest guy I think I've ever met in politics."
"I think he's an unstable person," he said, later declaring: "He's nuts."

Cruz also blasted Trump's sister, a federal appellate judge, calling her a "radical pro-abortion extremist" who should not be considered for the Supreme Court vacancy.
Trump's sister, Maryanne Trump Barry, is a judge on the 3rd U.S. Circuit Court of Appeals in Philadelphia. Trump has said she would make a good justice, but Cruz said she would not be a good choice, citing an opinion she wrote in 2000 that held a New Jersey law banning late-term abortions placed an "undue burden" on a woman's constitutional right to have the procedure.
Cruz then pointed at Trump's apparent confusion during a Republican debate last year over what constituted the nuclear triad as an example of how the real estate mogul is unprepared to be president.

When the tough get going they usually sue the crap out of those who point of his foibles or get him miffed and mess up his finely coifed hair.

Because his support amongst real conservatives - not the frauds that cheerlead for him - will completely dry up.
If Trump files his lawsuit - a big “if” considering he’s all bark - he will never win the presidency. Thus, his campaign is over the instant he does it.

Almost everybody has an opinion about the issue and agrees it's an unsettled issue. For me, just my personal view, is I'm uncomfortable with a foreign-born person with one non-citizen parent and being a resident and citizen of another country for the first few years of his life being "natural born". The longer the issue drags out, the more people will become solidified in their personal views.
Consider it called. Sue or shut up.
He does spell out his argument, in short forms, and in longer forms. The issue isn't put to rest because his argument is misleading and false, and a significant number of people recognize it as such. If enough people adopt his argument, he wins the argument. Truth is not a factor in this, mere belief is enough.

I see a parallel to this issue, in the argument over whether the 2nd amendment expresses an individual right, or a collective right (your right to bear arms depends on you being in a government-operated militia). For most of the country's existence, the RKBA was understood to be an individual right. The text of the 2nd amendment makes this clear, as do ALL of the SCOTUS precedents. But, people determined to disarm the public erected an academic consensus and a tremendous volume of bullshit. This even encroached into Federal Courts, which deliberately misconstrued SCOTUS precedent for the opposite of what it said. So, from roughly 1940 to 2010, it might be said that the prevailing wisdom was that the RKBA was a collective right, and states could constitutionally disarm their citizens.
At any rate, I agree with you. The longer this persists, the more likely the NBC clause will be forever written out of the constitution. Prevailing modern wisdom is that the constitution and original intent was to allow naturalized citizens to assume the office of the president.
Trump originally brought up the birther issue as he said in one of the debates because Cruz was doing too well in the polls. More recently, Trump has threatened a lawsuit...more churning of doubt to maintain his poll numbers.
Cruz has explained publicly his legal view of his own citizenship. The onus is now on Trump to follow through with his threat of lawsuit. If he does not, then he is just a blowhard pussy, a cowardly lion, all talk and no action just like all those “politicians” he rails about!!!

So let him write a position paper explaining it, with sources and research. He should've done that long ago. Perhaps he should drop out and spend the next four years getting it settled so everyone agrees with his legal view. In that time, he could help President Trump as they clean up the sewer that the US Senate has become.

Why? The onus will be on Democrat candidates like Trump to litigate the situation, hopefully as aggrieved parties, the LOSERS of the nomination and the general election to Cruz!
Yes, I'm a Trump supporter. I'm trying to keep it real on this issue. Because if we don't and Cruz is nominated, the dems will tie it up in court and he'll never be inaugurated.
Why didn't that happen with Obama? Because establishment 'pubs were either gutless wonders or complicit.

People have gone crazy. Trump was talking about his sister! He's not going to say his own sister isn't a good choice for anything.
People have reached into the bottom of the barrel for excuses on this one. Can't wait until primary season is over!

Trump is like a child. Anyone he dislike at the moment is the “worst ever” at everything. And everything he happens to like at the moment is “wonderful” and “great”. And his criteria for liking someone is often if they think highly of him. Putin, for example, is “great” because he complimented Trump.
This is why I’m a little suspicious of Trump’s “make America Great again!” slogan. Because I suspect Trump definition of America being Great can be as simple as “America where everyone loves Trump.” Because I’m pretty sure if Trump visited Cuba and they gave a great welcome ceremony and acted like they think he’s great he’d come back to US and tell us how “wonderful” and “great” Cuba is.
I understand your position, but I think this is only a political issue. Trump is using it to raise doubts about Cruz and it may well have stymied his rise in the polls. If Cruz is fortunate enough to win the nomination and the Presidency, this could then could then be given standing by a court. However, it is hard to believe that SCOTUS would ever decide against Cruz because the court would not want to overturn the decision of the electorate. It really is a political issue not a legal issue for which there is significant historical information to argue the case for Cruz as a NBC.
The one thing that the media and Trump are ignoring is the case against Marco Rubio. Although Rubio was born in the US, neither of his parents were US citizens when he was born. In fact they were both here illegally. So, does he really have standing to be considered truly a NBC? This could come up for Marco as well.
Like the Cruz case and also the case for John McCain (born in Panama), there is enough legal and historical evidence to make an argument on both sides of the NBC line for Senator Rubio. In fact, there was speculation that Mitt Romney passed on Marco for VP because there was concern over the NBC issue raised in 2012.
The bottom-line IMHO is that this is now simply a political issue that can be bandied about in discussion. In order for anyone to have legal standing to take this to court, one of these candidates will have to succeed in getting elected to POTUS or VPOTUS.

Now that is a reach! As far as the “frauds that cheerlead for him”, the results of yesterday's survey here on the Free Republic show that there are over twice as many people who support Trump here than “real conservatives” such as yourself.
Some of us find it offensive when self appointed holier than thou experts judge us to be not as pure as themselves and call us “frauds” and worse. Many of us have been life long conservatives and reached our decision as to which candidate to support through long deliberation and careful consideration. It is the height of hypocrisy and conceit.
If Cruz is still a factor after Super Tuesday I have little doubt that a lawsuit will be filed. I am sure that Trump's team of lawyers is very carefully considering the location to make sure that they will have the highest probability of being assigned a judge that will hear the case and that the appeal will be heard by in a Federal District where they will receive a panel of judges who will be the least sympathetic to Cruz.
You can thank the Senate for approving over 300 Federal judges hand picked by the Obama administration for increasing the probability that two of the three judges on the panel will give Ted the Thumbs down if Trump's lawyers give them anything that sounds reasonable to work with in the initial trial. From there it will be appealed to the Supreme Court which will either refuse to hear the case or be deadlocked now with four conservatives vs. four liberal justices after Justice Scalia’s untimely departure. Either way Cruz's fate will be in the hands of two liberal judges from wherever the Trump team decides to file... most likely somewhere in the 9th Circuit.
Even if the process takes a while, the doubt created in voter's minds by a real eligibility lawsuit being heard by a real judge will torpedo the Cruz campaign and Trump will keep barreling along like a run away freight train. Is this fair? No. Is this the way it will be done? Yes. Will the media try to come to Cruz's defense like they did with Obama? Don't make me laugh. Would it have been attempted before the death of Scalia? No.
Will the arguments made here about the finer points of constitutional law concerning Natural Born Citizenship make any difference to the two liberal Federal Judges assigned to be the executioners of Ted's campaign? Again get serious. Will the “true conservatives” sit another election out after their boy goes down in a predictable ball of fire? You tell me! Next time maybe the "true conservatives" will decide to support someone not born outside the country, whose father didn't fight alongside Castro during the revolution and maybe then your hopes might not be dashed. Until then stop acting like spoiled babies who couldn't give a damn about the fate of future generations.
