Since Ted Cruz walked onto the national stage, he has been consistent in leading the attack against the corrupt Washington Establishments of both parties. Redolent of Mr. Smith Goes to Washington. He has done that with a level of articulate intelligence and perception virtually unprecedented in Washington.
I served President Reagan in the White House Office of Policy Development, and I have studied his speeches and writings for years. Cruz embraces the same three dimensional political and policy framework as Reagan - fearless, consistent, free market economics, Peace through Strength National Defense, and Traditional Values Cultural Conservatism. On issue after issue, I can see no difference between Reagan and Cruz in any of these dimensions.
Like Reagan, Cruz is a convictions politician, in the words of former British Prime Minister Margaret Thatcher. That means that Cruz, like Reagan, and Thatcher, is transparently in politics to advance his conservative "convictions," philosophy, and ideology, not for personal aggrandizement, power, or riches.
Conservatives, from Christian Evangelicals, to Tea Party fire brands, to Libertarian free market activists, to low tax crusaders, to Second Amendment, gun rights advocates, to National Defense, foreign policy conservatives, to traditional, family values, cultural conservatives, are now coalescing around Cruz. I believe they will put him over the top in Iowa, and carry that momentum to New Hampshire, South Carolina, Nevada, and Super Tuesday states throughout the south. That run may resolve the nomination contest much sooner than now expected. Below are the reasons why this is happening...

yeah yeah, he’s great. Too bad he isn’t a natural born citizen.
What a great piece!
So detailed.

"......Birthers have been asserting that, since Rafael Cruz did not become an American citizen until 2005, and while he was in Canada with his wife, during which time Ted was born, he became an Canadian citizen. This, in the Birthers' view, disqualifies Ted from this Presidency, as "the Founders" never would have intended someone like him becoming President
But look closer at the bolder portion.
>>>>"And the children of citizens of the United States, that may be born beyond sea, or out of the limits of the United States, shall be considered as natural born citizens: Provided, That the right of citizenship shall not descend to persons whose fathers have never been resident in the United States...<<<<
It never says that the father has to be a citizen of the United States at the time the child is born. All it says is that citizenship "shall not descend to persons whose fathers have never been resident in the United States." It is indisputable that Rafael Cruz was in the United States for a period of time prior to both Ted's birth and his marriage to native born American citizen Eleanor Elizabeth Darragh Wilson in 1969. He fled Cuba in 1957 at the age of 18, arriving in Texas. There, he attended the University of Texas, graduating with a degree in mathematics in 1961. He even married his first wife there, Julia Ann Garza, in 1959. They later divorced, but not before he had two daughters with her. He was also granted political asylum in 1961 upon his graduation from UT.
In other words, Ted Cruz's birth meets everything required in this 1790 act. His mother, Eleanor Wilson, was a citizen by birth in the United States, fulfilling the requirement of a child being born to at least one citizen, and his father had lived in the United States for years and been granted political asylum here prior to his move to Canada."..
Great article.
I’m still voting Trump because I feel he is the best conservative that can win the Presidency.
1 Abbott (U.S.) 28, 40, 41.
The Supreme Judicial Court of Massachusetts, speaking by Mr. Justice (afterwards Chief Justice) Sewall, early held that the determination of the question whether a man was a citizen or an alien was "to be governed altogether by the principles of the common law," and that it was established, with few exceptions, "that a man born within the jurisdiction of the common law is a citizen of the country wherein he is born. By this circumstance of his birth, he is subjected to the duty of allegiance which is claimed and enforced by the sovereign of his native land, and becomes reciprocally entitled to the protection of that sovereign, and to the other rights and advantages which are included in the term 'citizenship.'"
Too bad you’re illiterate.
True that. This is, btw, the only time in American law, AFAIK, that any sort of technical definition was ever attached to “natural born citizen” and it specifically allows a jus sanguinis (”right of blood”) basis where a jus soli (”right of the land”) basis was missing. That’s interesting because it devastates the theory that everyone was treating Vattel as gospel in this area. It really does sound as though the common law influence on vocabulary was substantial.

There is no evidence indicating that Trump is conservative.
Thanks for your opinion.
My opinion is he s the best conservative that can win the Presidency.
A majority of law students will attest to the dictum that on any given issue the law of Massachusetts is at odds with the majority.
You know, but conveniently choose to ignore, that statutes cannot and do not interpret and/or change the plain language of the Constitution - no matter how many times you post the 1790 statute, which you also know was superceded by the 1795 statute which re-affirmed NATURAL BORN CITIZEN.
Either way, you continue to lose.
Either way, you Cruz you Luz.
I suppose you actually meant the best liberal than can win?
Why not just vote for the Hilda-beast, she’s arguable more conservative than Trump.
Oh yes, CAPS make it so.

"require the opinion, in writing, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices,"
required the opinions of the members of his cabinet upon several questions of allegiance, naturalization and expatriation. Mr. Fish, in his opinion, which is entitled to much weight as well from the circumstances under which it was rendered as from its masterly treatment of the subject, said:
"Every independent State has as one of the incidents of its sovereignty the right of municipal legislation and jurisdiction over all persons within its territory, and may therefore change their nationality by naturalization, and this without regard to the municipal laws of the country whose subjects are so naturalized, as long as they remain, or exercise the rights conferred by naturalization, within the territory and jurisdiction of the State which grants it."
"It may also endow with the rights and privileges of its citizenship persons residing in other countries so as to entitle them to all rights of property and of succession within its limits, and also with political privileges and civil rights to be enjoyed or exercised within the territory and jurisdiction of the State thus conferring its citizenship."
"But no sovereignty can extend its jurisdiction beyond it own territorial limits so as to relieve those born under and subject to another jurisdiction from their obligations or duties thereto, nor can the municipal law of one State interfere with the duties or obligations which its citizens incur while voluntarily resident in such foreign State and without the jurisdiction of their own country. "
"It is evident from the proviso in the act of 10th February, 1855, viz., 'that the rights of citizenship shall not descend to persons whose fathers never resided in the United States,' that the lawmaking power not only had in view this limit to the efficiency of its own municipal enactments in foreign jurisdiction, but that it has conferred only a qualified citizenship upon the children of American fathers born without the jurisdiction of the United States, and has denied to them what pertains to other American citizens -- the right of transmitting citizenship to their children -- unless they shall have made themselves residents of the United States or, in the language of the Fourteenth Amendment of the Constitution, have made themselves 'subject to the jurisdiction thereof.'"
"The child born of alien parents in the United States is held to be a citizen thereof, and to be subject to duties with regard to this country which do not attach to the father.
"The same principle on which such children are held by us to be citizens of the United States, and to be subject to duties to this country, applies to the children of American fathers born without the jurisdiction of the United States, and entitles the country within whose jurisdiction they are born to claim them as citizen and to subject them to duties to it."
"Such children are born to a double character: the citizenship of the father is that of the child so far as the laws of the country of which the father is a citizen are concerned, and within the jurisdiction of that country; but the child, from the circumstances of his birth, may acquire rights and owes another fealty besides that which attaches to the father."
"By the Thirteenth Amendment of the Constitution, slavery was prohibited. The main object of the opening sentence of the Fourteenth Amendment was to settle the question, upon which there had been a difference of opinion throughout the country and in this court, as to the citizenship of free negroes, Scott v. Sandford, 19 How. 393, and to put it beyond doubt that all persons, white or black, and whether formerly slaves or not, born or naturalized in the United States, and owing no allegiance to any alien power, should be citizens of the United States, and of the State in which they reside. Slaughterhouse Cases, 16 Wall. 36, 83 U. S. 73; Strauder v. West Virginia, 100 U. S. 303, 100 U. S. 306."
"This section contemplates two sources of citizenship, and two sources only: birth and naturalization. The persons declared to be citizens are 'all persons born or naturalized in the United States, and subject to the jurisdiction thereof.' The evident meaning of these last words is not merely subject in some respect or degree to the jurisdiction of the United States, but completely subject to their political jurisdiction, and owing them direct and immediate allegiance. And the words relate to the time of birth in the one case, as they do
Page 169 U. S. 725
to the time of naturalization in the other. Persons not this subject to the jurisdiction of the United States at the time of birth cannot become so afterwards, except by being naturalized, either individually, as by proceedings under the naturalization acts, or collectively, as by the force of a treaty by which foreign territory is acquired."
To be "completely subject" to the political jurisdiction of the United States is to be in no respect or degree subject to the political jurisdiction of any other government.
Actually the applicable Federal statute was written in 1952 not 1898.
