The Democrats intend to charge Petraeus.
They are expecting a popular and Conservative outrage and revolt.
So they will drop the prosecution and make a big deal of it.
But they will use this action to also drop any prosecution of Hillary. They will claim
"What Hillary did was no different than what Petraeus did."
Your theory drips cynicism. I like it. It sounds plausible.

It was run and paid for by the Clinton Foundation. She didn’t pay the bills....they (the Foundation) paid them. You can find probably a dozen figureheads to the Foundation who sign checks and authorize actions. The odds that a piece of paper exists with her signature asking or demanding the servers? Zero percent chance.
Oh I agree it’s a crime....but who cut-and-paste the classified into the messages? Every single instance I’ve seen....it’s State Department staff members. Hillary doesn’t cut-and-paste nothing (I don’t believe she’s even that smart). So, then they (the State Department staff) send the messages to the non-State Department server. In my book, they (the State Department staff members) are guilty of various issues.
Once Hillary receives each message....it’s plain text with no markings (like you’d expect for a classified message)....so she can say in any deposition or court....she didn’t know they were classified. Legally, the judge will have to accept that answer and she’s off the hook. The State Department members who sent the cut-and-pasted messages? They are screwed.
I know this is all bad ethnics and poor management style, along with gross violation of security practices....but you can’t walk into a court and find any cause to arrest or hinder Hillary. She’s not the owner of the server (the Foundation is). She didn’t pay for the service of the server (The Foundation paid).
The Clinton Foundation is a mafia-like device and designed that way. That’s probably the amazing part of story....you can’t bring the Foundation down. If you really wanted to hurt the Clintons....get some judge to identify the Foundation with tax or legal issues and freeze their bank account. Watch how they’d freak out then.
The question is WILL the DOJ follow through with an indictment?
If here popularity numbers continues to drop she's liable to be tossed under the bus.

This is where you are wrong. She won't skate the charge at all. It was her server, in her house, directed by her. That it contains calcified information is the crime, not who put it there.
