RESOLUTION
Recognizing that John Sidney McCain, III, is a natural born citizen.
Whereas the Constitution of the United States requires that, to be eligible for the Office of the President, a person must be a "natural born Citizen" of the United States;
Whereas the term "natural born Citizen", as that term appears in Article II, Section 1, is not defined in the Constitution of the United States;
Whereas there is no evidence of the intention of the Framers or any Congress to limit the constitutional rights of children born to Americans serving in the military nor to prevent those children from serving as their countryâs President;
Whereas such limitations would be inconsistent with the purpose and intent of the "natural born Citizen" clause of the Constitution of the United States, as evidenced by the First Congress's own statute defining the term "natural born Citizen";
Whereas the well-being of all citizens of the United States is preserved and enhanced by the men and women who are assigned to serve our country outside of our national borders;
Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President; and
Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936: Now, therefore, be it
That John Sidney McCain, III, is a "natural born Citizen" under Article II, Section 1, of the Constitution of the United States.
The McCain non-binding resolution was sponsored by McCaskill, Leahy, Obama, Clinton, Webb, and Coburn and was based on an opinion commissioned by the senate from Laurence Tribe and Ted Olson.
In the Tribe/Olson opinion there was a gratuitous statement finding Obama eligible because he was born in Hawaii (jus solid).
Or as a patriot who loves the constitution he is willingly sacrificing his political career to take down the progressive democrat party.

I don’t expect Cruz to do that. He is apparently certain that ‘equality for women’ would win over originalism regarding his natural born status. Otherwise he would never have run.
But the mistake in that logic is that people don’t respect court opinions anymore. If there’s a way to taint, partizans will exploit it.

More than likely, he merely lent his name to the SR so he could claim credit for doing it. That’s been his pattern.
Question for the Cruz controllers...
Why did McCain need a Senate resolution in the first place? If it’s OBVIOUS that natural born citizen simply refers to “being a citizen at birth,” why would there even have been a question?

That’s one reason why it would be a huge feather in his hat if Cruz could discredit Tribe on this issue. Best I can tell, he can’t.
It’s original intent v. equality for women, and since that leaves doubt — eligibility might be won in court, but tainted at the same time.

Congress cannot change the definition of a word in the Constitution. Natural born for the purposes of being eligible to be President will forever mean whatever the Founders believed it to mean at the time of the adoption of the Constitution.
I think the new issue, and Peggy Noonan writes about this, is that where is the collegial support for Cruz? No one is coming to his defense. I mean, isn’t that odd?
It tells me that Trump will negotiate and win over these GOPe guys whereas Cruz never will.

Not that it means all that much, especially now.
Part of the reason it was missed? Obama is a member of a protected class. Imagine the strength of character that would be required to be the first to step up and point out that Obama is not eligible?
Obama- not eligible
Cruz- not eligible
Rubio- not eligible
Period.
The fig leaf Resloution for the ineligible McCain was used as cover for the ineligible Obama. Both parties wanted the definition of natural born citizen changed.
Actually, Cruz could point to Obama and claim, by extension, he should also be okay.
At least, then, Cruz would take down Obama.
I don’t think Cruz wants to get the comparisons with Obama started being that they were both lightweight freshman senators.

No you’re not, and it’s a valid question. People are intimidated by this because it has contradictory interpretations. The tricky part was finding people who knew what they were ‘talking about’.
[I’m no lawyer, but even lawyers have trouble with this — it’s a specialty topic.]
But we’ve been able to boil it down to two major points ...
1. Original intent. No matter what original intent you look at, Cruz is not eligible.
— Some say ‘must have mother and father — US citizens when overseas.
— Some say ‘must at least have US father when overseas’
— Some insist you must be born in the US.
2. Women Equal.
Now for the ‘women equal’ argument.
As you know, women are treated as equally as possible in the courts these days. That’s what Cruz is banking on — why can’t a mother alone make him qualify?
— But that is not original intent. So while it wins in court, it fails to end the controversy.
That’s it basically.
Ideally, we are best off to have someone absolutely rock-solid as ‘natural born’ by all major definitions.
The only reason we respect Cruz’ argument at all is because he’s such an awsome patriot-scholar in every other respect. Even his arch-enemy Tribe makes that clear [as noted above].
There are two ways to look at this. The theory, and the practice.
In fact, we are under a lawless and corrupt government, that has subverted the constitution in myriad ways. A new Declaration of Independence would read just like the one with the July 4, 1776 date on it.
I musta missed that part of “government” that says that a Senatorial Resolution supersedes the wording of the Constitution.
That Constitution thingy says “natural-born”, a term that has AN ACTUAL, LEGAL MEANING. (No, it has nothing to do with the location of mommy’s VJ, either.)
“So, where are Cruzâs friends. They could easily do this for him.”
Cruz does not have any friends any longer in the GOPe. When he refused to screw the citizens by touting the party hype and propaganda along with not throwing his full support toward little Yebbie, they turned on him like a rabid dog.
