Lawyer Challenging Ted Cruz Eligibility Was Suspended From Practice of Law

A birther lawsuit challenging Ted Cruz's eligibility was filed today in federal court in Texas. I had previously written that such a lawsuit challenging the eligibility would most certainly lack standing and would be frivolous. The lawyer who filed the complaint, Newton B. Schwartz, Sr., had been suspended from the practice of law by two separate states for disciplinary infractions.

According to the detailed disciplinary ruling against Schwartz in Louisiana, he engaged in legal matters in Louisiana but was never admitted to practice law in the state and never sought temporary admission. (You can read the lengthy disciplinary case against Schwartz here).

The Louisiana Office of Disciplinary Counsel filed formal charges against Schwartz on July 19, 2011. In February 2014, Schwartz was suspended from attempting to practice law in Louisiana.

Louisiana disciplinary counsel alleged that Schwartz had a swarm of ethical violations. They include "engaging in conduct involving dishonesty, fraud, deceit or misrepresentation."

Schwartz was also barred from practicing in Pennsylvania. According to the Pennsylvania Supreme Court, Schwartz consented to his suspension from the practice of law in Pennsylvania.

Schwartz remains a member of the Texas Bar.

Is he eligible now? Are you saying you must be a lawyer to bring a lawsuit? Are you saying because this guy has been suspended Cruz isn’t an illegal?

Whoa, slow down there!! The logic is that since the lawyer has been disbarred, Cruz wasn;t naturalized. Not only is Cruz a citizen, he is a natural born citizen of Canada the United States.

Doesn’t much matter, Alan Grayson is going to sue.

Remember that the Dems sued Gov. Palin, she had to resign her office to fight the suit and then the Dems dropped the law suit.

Ted has to go for a ruling in court, on his own.

This ways Ted avoids the Dems dragging this out as long as they can to bleed him.

Grayson files if and after the GOP nominates Cruz.

Schwartz filed January 14. It's a live suit in Federal Court.

The court won't touch it. But ....

Cruz, who says this is settled law - but the public is hearing is unsettled - will go to court and argue that the court should not confirm that the issue is settled.

Trump will figure out something to say, about that.

Us legal junkies will get to see his expert legal argument that concludes he is NBC.

This is a gift horse. When you have to fight, you prefer it to be against a poor adversary. If cruz is going to pursue a quick judgement, here is as good of a scenario as he’s going to find.

Inaction is hurting Cruz. In one poll one quarter think him not eligible. If he has the case won go get a court to agree with you. Looks bad not going to court, looks like you don’t have the facts on your side.

Dems don’t care if they have nothing. They hounded Palin from office, they got Tom Delay out of office and it cost him millions to eventually win several court cases.

Can you imagine if Tom Delay was speaker instead of pip squeek Ryan. Tom would HAMMER Obama.

Yes. If a non practicing lawyer files then that proves Cruz is a natural-born citizen. It’s natural logic.

I’m no fan of Cruz, but he really should get this cleared up if he can. There will be other elections, including the one for VP. He can fight the fight now, or later against more formidable plaintiff in a far worse venue.

The courts will probably toss it if Cruz moves to dismiss. A tactical victory, but a strategic mistake. You can bet that the rats will pursue the issue with a singleminded intensity if he emerges as the nominee or VP

I think the bigger question he needs to answer is whether he really thinks he has a good shot at the presidency or VP. No need for a strategic win if he doesn’t think he’ll need it.

Grayson is the scum of the Earth. Luckily he is giving up his House seat to run for the Senate, and not even the statewide Florida Dems like him.

Aye, they certainly will. Which shows that Cruz does not want a court to confirm that it is settled law. It is settled law alright, and it goes the other way.

The courts are not required to dismiss it, they dismiss it on motion by defendant. The defendant can argue the case on the merits. It's wholly defendant's option.

I don’t know why it is important to keep stressing this lawyer is disbarred, except to point out he may be less than honorable Anyone, disbarred or dishonorable or not, can bring a lawsuit against another if he feels wronged. Some seem to think it means he can’t bring suit????
