Sen. Ted Cruz might finally get the chance to prove he is eligible to run for president once and for all.
A Houston-based attorney has filed a lawsuit against Cruz, asking the U.S. Supreme Court to settle whether Canadian-born Cruz is eligible for the presidency. Noting that the Iowa caucuses are just weeks away, the attorney asks the court to expedite the case as quickly as possible.
"This 229 year question has never been pled, presented to or finally decided by or resolved by the U. S. Supreme Court," wrote attorney Newton Schwartz in his lawsuit that he filed Thursday. "Only the U.S. Supreme Court can finally decide, determine judicially and settle this issue now."
He writes: "It is undisputed, by all legal scholars, there is no U.S. Supreme Court decision or precedent: determinative of the following agreed facts of this case and controversy. 'Natural born citizen' has never been defined."
Schwartz asked the court to rule that Cruz is not eligible to run for President.
The Cruz campaign declined to comment on the suit, but said Cruz has no connection Schwartz.

This is why we need to overhaul the SCOTUS! These a$$holes avoid any real work by their “how many angels can dance on the head of a pin” approach to the work that they should be doing. We need to establish a refrendum process whreby all of them have to stand for the scrutiny of all of us every few years (by few, I mean no more than 5). They are like unlicensed doctors picking at scabs, and never healing anything.
None of the Trumpettes will abandon Trump over this. Instead the will further canonize Trump for clearing up the issue, and taking it off the table.
Anyone who says Cruz is not a citizen does not know the law. A person who is born to a citizen regardless of where that citizen was born is a natural born citizen. This is because under the law only one parent has to be a citizen to confer natural citizenship on their offspring.

Just for the record, I’m a Cruz guy first with Trump a close second. Nobody else, including Rubio who does not meet the NBC qualification himself BTW is on the Radar.

Um you do realize that the act in 1790 was repealed and replaced in 1795, explicitly changing NBC to just citizen, right?
Very troubling to conclude that:
1)naturalized US citizens who swear fealty to the US
2)children born on foreign soil to US citizens and
3)children born in the US to legal immigrants waiting for naturalization
do not have equal rights: i.e. the right to become POTUS even though voters exercise their desire to elect them.
The Founders’ intent (to prohibit pro-British pro-monarchists from the office) have long since become moot.
Time to tidy up the parameters for POTUS eligibility. Otherwise we have millions of second class citizens.
Show us that law. Please cite a specific statute supporting your claim.
I hope this guy’s case gets fast tracked because its a non issue.

The act in force at the time of birth controls. When that doesn’t satisfy political desires resort must be had to acts repealed centuries ago. And when even that is not enough those acts can be carefully mixed with other acts producing a new act, an act never passed by Congress.
Dismembering repealed naturalization acts and carefully selecting phrases from the entrails is not law, it’s voodoo.

He was crowing that he was ready to go if Cruz was Nominated. Colmes was orgasmic at the prospect.
