Houston attorney asks Supreme Court to rule Ted Cruz ineligible for presidency

Sen. Ted Cruz might finally get the chance to prove he is eligible to run for president once and for all.

A Houston-based attorney has filed a lawsuit against Cruz, asking the U.S. Supreme Court to settle whether Canadian-born Cruz is eligible for the presidency. Noting that the Iowa caucuses are just weeks away, the attorney asks the court to expedite the case as quickly as possible.

"This 229 year question has never been pled, presented to or finally decided by or resolved by the U. S. Supreme Court," wrote attorney Newton Schwartz in his lawsuit that he filed Thursday. "Only the U.S. Supreme Court can finally decide, determine judicially and settle this issue now."

He writes: "It is undisputed, by all legal scholars, there is no U.S. Supreme Court decision or precedent: determinative of the following agreed facts of this case and controversy. 'Natural born citizen' has never been defined."

Schwartz asked the court to rule that Cruz is not eligible to run for President.

The Cruz campaign declined to comment on the suit, but said Cruz has no connection Schwartz.

All Cruz needs to do is call a press conference and present a pdf version of his birth certificate with impossible typewriter spacing and other inaccuracies.

Also, Cruz made a mistake with his "New York values" remark. He should've been more specific and not used such a broad term for Trump to pounce on.

Yes, they do. They are under the delusion Trump & Cruz have been secretly plotting together all along so the almighty Trump can then offer Cruz a VP spot.

Curious as to this standing issue. Does this mean the requirements to be a Congressman or POTUS laid out in the Constitution are essentially worthless because nobody has standing to sue?

Any child born beyond Sea, whose father or mother or both at the time of the birth of such child may or may not have been a citizen of the United States, shall be considered as a natural born citizen of the United States.

One part 1790 Act, one part 1934 Act, shake and pour over ice. Garnish with maple sugar candy et voila, natural born citizenship!

Two other Harvard Lawyers on the Harvard Law Board said that Cruz is eligible.
One worked for George W Bush, who is no friend of Ted Cruz now. W recently said “I just don’t like the guy”.
The other worked on Gore’s Hanging Chad debacle (Cruz worked for Bush on that). I’d say that he is at least ideologically opposed to Cruz.
So two players who really have nothing to gain in this fight support Cruz.
I think that is telling.

If I remember correctly, the Obama suits were all bounced because of lack of standing. The thinking being the plaintiff cannot demonstrate a harm caused specifically to him/her.

I have no idea (not that anyone does), but if Cruz wins the nomination, perhaps the Dem nominee would have standing because the harm/injury would or could be Cruz keeping his Dem opponent from becoming president.

So where does that leave us when the Ninth Circus declares Ted to be a Canadian?

Considering the 9th Circus is the most overturned court in the land, that would be a boon to Cruz in front of SCOTUS... But to answer your question, if by some miracle they managed to get some court to find a plaintiff with standing and made a ruling against Cruz, then you would see SCOTUS take the case. But most courts will not touch a "political" issue.

Already adjudicated by the Federal Courts in Robinson v. Bowen (challenge of McCain's status). Robinson v. Bowen created legal precedence, was a very broad ruling (defined all citizenship conferred automatically at birth as "natural born"), and would have to be considered in any new ruling.
