“Only someone like Trump would offer a former solicitor general, who has argued before SCOTUS multiple times, legal advice.
It makes as much sense as Cruz advising Trump how to stay out of bankruptcy. “
Well then you know what? Cruz should do NOTHING on this.
Let it sit. Wave around how he augured cases before SCOTUS, and that will make it settled?
Hate to break it to some of you, but if he does not clear this up NOW, and he happens to be the nominee, the Democrats will take it to court. Will get a friendly judge, and Cruz will be fighting this in courts in October, or be off the ballot.
Sorry if this pisses off Cruz people, but this is not some thing to just kiss off and act like no one will use it on the Democrat side the first chance they get.
Especially as much as people on our side routinely say Obama is really a Kenyan national. You think the Democrats aren’t going to?
With any luck, this would drag Odumbo’s situation into this mess as well, perhaps as an example of precedent, which would then need to be analyzed in great detail.
Let it sit. Wave around how he augured cases before SCOTUS, and that will make it settled?
I don't necessarily disagree. But, assuming Cruz does want to settle this matter, he needs to wait until a proper defendant is identified.
With this type of declaratory judgment, it's not enough to tell a court - look, I think someone, somewhere might sue me in court and test my eligibility at some time.
Now, if a secretary of state or a board of election somewhere indicated they were going to keep him off the ballot that may be enough for the suit to proceed. Or, a regular joe or political operative who tells the press they are lawyered up and ready to file suit.
In other words, there needs to be a clear indication suit will be filed against him on this matter and/or that he is in actual danger of being kept off a ballot in a place he would otherwise be qualified.
