US Constitution Article 1 Section 8 -
“To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;”

Thus the rules of naturalization which includes who does and who does not need to be naturalized, is vested as an enumerated power of Congress, exclusively.

Congress expresses it’s will via laws called acts. In the first acts of Congress, they passed the Naturalization Act of 1790 that clearly establishes that a natural born citizen does not HAVE to be born on US soil if born abroad to US parent(s). https://en.wikipedia.org/wiki/Naturalization_Act_of_1790

Further, the current law as expressed in US Code Title 8 section 1401 (https://www.law.cornell.edu/uscode/text/8/1401). In subsection G:

(g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years:

Clearly indicates that Sen Cruz, via his mother’s citizenship, was a US citizen at birth and as such was naturally born a citizen and did not, does not, and will not EVER need to be naturalized.

Sorry.

The immigration and naturalization act of 1790 specifically EXCLUDES Cruz.

It says... “not descend to persons whose fathers have never been resident in the United States.”

Besides, at this point it’s talking about citizenship, not natural born citizens.
