Delivering on its promise to deliver "common sense" gun control, the Obama administration on Monday finalized a rule that enables health care providers to report the names of mentally ill patients to an FBI firearms background check system.
The action was one of a series of steps that President Barack Obama had called for in January 2013 in the wake of the Newtown, Conn., shootings to curb gun violence, but the rule was not published until today.
While the 1993 Brady law prohibits gun ownership by individuals who have been involuntarily committed, found incompetent to stand trial or otherwise deemed by a court to be a danger to themselves or others, federal health care privacy rules prohibited doctors and other providers from sharing information without the consent of their patients.
Under the rule, which takes effect next month, for the first time health providers can disclose the information to the background check system without legal repercussions.

Oh, Heck yes.
A local lady, who owned guns already, started the process at the local gun shop for another one.
Because she went for counseling after a divorce some time ago, she was denied, and was to turn in all her existing guns.
This is CA, but soon could be everyone.
Gee, how does this square with HIPAA?

Define “mentally ill.”. You mean like men who think they’re women? Or men who bugger each other? Or do you mean people who think “shall not be infringed” means “shall not be infringed”?
That depends on whether the Doc is subject to civil suit or not.
Theres 435 of them on Capitol Hill.
This is madness.
Part of the problem is that they won’t even commit the dangerously mentally ill, and so now any minor complaint gets lumped in with those who long to carve their neighbors up like a turkey.
Neither is 0buttbongo’s prescience in the Oval Office..
And stay away from psychiatrists.

Pretty soon anyone who has NOT seen a psychiatrist or does not have ‘anxiety, etc.’ will be the ‘odd’ one; normal will be abnormal.
After I had my first heart attack, one of the ‘team’ doctors came to see me, asked me if I was a member of the NRA or did I own a weapon...told him he was there to treat my health, and it was none of his business how I lived my personal life...
When my heart doctor came in later, he remarked that the other ‘team’ doctor thought I had became upset over the answer I gave him, I told my heart doctor I wasn’t upset at all, he asked, I answered...doc just laughed....
Some of the questions these doctors ask now days are way to much information for me....
Ever had a prescription for Valium? Kiss your gun rights goodbye.
On Zoloft? Same.
If I tell my doctor to GFY when he asks me if I have any guns in the home, will I be listed as mentally ill?
So, VA docs are good to go on reporting your twitch in your left eye as a sign of possible terror traits? :>)

As if sensible people needed another reason to avoid the charlatans known as doctors.
Profiting off of illnesses that are beyond their desire to alleviate is as dishonest as one can get.
We need Ted Cruz in office to deal with this attack properly.

This creates a conflict between Law (HIPPA) and administration rules. A doctor who reports could be setting themselves up for at a minimum, a law suit and quite possibly criminal prosecution.
I’ll tell him I’m holding them for my Obama voting neighbor.
