Mitchell Large made the decision to break into a Florida home Monday morning but didnât exactly face the greeting he was expecting.
The family whose home he broke into were all packing heat. For Those Keeping Score: Armed Family 3; Intruder 0

I’d feel pretty good, as the father of the house, having two other marksmen in the family ðð

Luis Pena Jr. was found by a court to be within his right and legally justified in shooting and killing the scumbag.
I wonder why this even made it to court ?

The poor homeowner is going to have to repair the damage from the warning shot into the wall, and clean up the blood. I hope the intruder’s survivors don’t have the Chutzpah to sue the poor family he tried to rob.
To: Eddie01
This is indeed a great story. I hope that the Pena family gets a reward for taking a scumbag off the streets permanently.
Breaking into somebody's home is right up there with rape and murder in my opinion. A real low-life crime.

Nice end of the year story.

Aggressive prosecutors have attacked homeowners and individuals for defending themselves as law currently puts it on the individual to prove they were defending themselves. Legislature working to change this.

Good question - I wonder that also!!
On March 23, 2005, The Florida Senate passed SB-436, the 'Castle Doctrine' unanimously, by a vote of 39 YEAS to zero NAYS. They know something about this bill.
On April 5, The Florida House passed SB-436, 'Castle Doctrine' by a vote of 94 YEAS to 20 NAYS, a margin of better than four to one.
On April 26, Governor Jeb Bush SIGNED SB-436, the 'Castle Doctrine' into law (Chapter No. 2005-27) It takes effect on October 1, 2005................
The Florida "Castle Doctrine" law basically does three things:
One: It establishes, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle is there to cause death or great bodily harm, therefore a person may use any manner of force, including deadly force, against that person.
Two: It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others. [This is an American right repeatedly recognized in Supreme Court gun cases.]
Three: It provides that persons using force authorized by law shall not be prosecuted for using such force.
It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them.
