Mitchell Large made the decision to break into a Florida home Monday morning but didn’t exactly face the greeting he was expecting.

The “court” reference is vague - might’ve been simply a grand jury review of the case (the usual procedure in these cases).

The dad fired a warning shot above the door, MyFoxOrlando13 reports, but the intruder was not detered.
Back to the start:
Luis Pena Jr. awoke about 6:30 a.m. to the sound of a person on the back porch of his family`s house at 4219 Lake Marianna Drive, according to Winter Haven police.
Pena walked into the kitchen and saw a man trying to open the French doors, police said. Pena ran back to his bedroom, woke up his parents and armed himself with his silver .357-caliber revolver, according to a police report.
He then went back to the kitchen and fired one warning shot into the wall above the French doors, the report states.
At that time, Pena`s parents, Vicentia and Luis, also armed themselves and went into the kitchen, police said.
The homeowners told police they yelled for Large to stop, but he continued to break through the doors and started charging toward them once inside.
Pena fired a second shot and his mother fired one shot, police said. Luis Pena`s bullet hit Large in the chest and Vicentia Pena missed, police said.
`When Large continued into the kitchen, mom and son opened up, killing him,` BizPacReview writes.
`It appears at least two of the family members fired in defense of themselves and their property,` Police Chief Gary Hester explained.
`It`s not a very far reach to assume that if someone`s forcing their way into your residence early in the morning, they`re not there to wish you well,` Hester said of the break in. `That`s your castle that a reported intruder is coming into, so whether he was armed or not armed, when he failed to retreat, they certainly had a right, if it turns out this way, would have a right to defend themselves.`
One of the neighbor`s defended the response.
`That`s the way that I would react. I`d hate to do that; I`d hate to shoot anybody. But if it comes to me or them, I would,` the neighbor said. `I hate that he died, but you got to take a stand against this people that`s doing this stuff.`
`Authorities said the family`s 20-year-old daughter was also in the home and armed, but did not see what happened,` MyFoxOrlando13 notes.
She must be a heavy sleeper..
UPDATE: Luis Pena Jr. was found by a court to be within his right and legally justified in shooting and killing the scumbag.

But this is exactly what the left hates. They want the savages to waltz in and take what is “rightfully “ theirs from their “oppressors”.
The solution is to make the state liable for the cost of these defenses as a matter of mandatory law.

Because liberal/socialist/marxist/progressives are always looking for that ONE CASE where it might be a "bad shoot" to bolster their gun-grabbing/disarm all American's agenda.

If they were prosecuted then the prosecutor should be fired if not disbarred.

I did some digging. This article sucks, but it is an opinion piece. The article calls it the feel good story of 2015.
This shooting happened in april 2014.
It never went to court.
In May 2014, the State Attorney’s Office said Pena was justified in shooting and killing Large, and no charges will be filed against him.

Haven’t read past this comment before replying, so if others said the same thing, great minds think alike :).
In a refreshing twist, the homeowners should use the perp’s family for damages and repair/cleanup costs.
