What is the correct position? That he does not “intend” to support legalization.

He’s not saying Hell no, I won’t support legalization. It’s lawyer weasel words like what is the definition of “is.”

He did, in fact, after the debate, just to allay your concerns about “intend”, clarify using your language, “Hell no to legalization.”

That's just Cruz being colloquial. For instance, Joe Palooka might say: "I haven't spoiled my kids in the past and I don't intend to spoil them in the future".
