A Florida deputy has been indicted for manslaughter in the shooting death of Jermaine McBean, who was killed while walking home with an unloaded pellet gun he had just bought a pawn shop.
Broward County Sheriff Peter Peraza â who was given a bravery award for the shooting by his bosses while it was still under investigation â surrendered early Friday, prosecutors said. He faces up to 30 years in prison if convicted.
It's the first time since 1980 that a police officer in Broward County has been indicted for a fatal on-duty shooting.
The grand jury began hearing testimony and evidence a week ago â more than two years after McBean, a 33-year-old computer engineer, was shot dead in the courtyard of his Broward County apartment building.
As NBC News has reported in a series of stories about the case, a lawyer hired by McBean's family uncovered evidence that appeared to contradict some aspects of the police account of the shooting.
One of the people who called 911 after seeing McBean walking down the street with the rifle told NBC News that he had the gun yoked across his shoulders and did not point it at officers before he was shot.
In addition, a photo of McBean just after he was killed showed him wearing ear buds â even though police insisted he didn't have anything in his ears that would have stopped him from hearing their demands to drop the rifle.

In defending yourself with a firearm, you should keep the perp at least 20 feet away to ensure your own safety. Who can see ear buds in an ear at 20+ feet?
If perp was so stupid as to keep the ear buds in his ears when walking down the street with a rifle of any kind in his hands and not take them out to hear what the LEO is saying, that is felony stupid.

Ok, so the dead guy was stupid. But cop was criminally negligent. I mean, what, you ask someone to freeze and drop the “gun” and he just keeps on walking, seemingly ignoring you, so you... what? What should a cop do then? Unloading a pistol into him is not an option in any free, non-tyrannical society. The fact that that is the go-to response of many in “law enforcement” today just shows you we are no longer living as a free people. Americans can now be killed because they accidently frighten some pathetic jackboot, and there are no repurcussions.
But than again, I'm just an average law abiding citizen, with a documented history of wielding multiple weapons, both openly and concealed.
Care to explain what criminal act he perpetrated?
