It is against to law to collect metadata on everyone. They can get a warrant from any court.

I do believe they have the grounds for a search warrant./s

The NSA metadata is no longer available, period. What can happen is that a warrant can be attained to get the data from the phone companies. What this article is pointing out is that the phone companies only have 2 years of data when the NSA has 4 years.
