Authorities Sunday night identified the man who became stuck in the chimney of a Huron home during a botched burglary attempt and died after the homeowner lit a fire in the fireplace.
Tony Botti, spokesman for the Fresno County Sheriff’s Office, said the man identified by the county coroner was 19-year-old Cody Caldwell. The cause of death was smoke inhalation and burns, Botti said.
Sheriff’s Lt. Brandon Pursell said deputies received a 911 call to the 16000 block of West Gale Avenue just before 3 p.m. Saturday. After lighting a fire, the male homeowner heard screams coming from somewhere inside the house. When the resident realized a person was in the chimney, he extinguished the fire.

They’ll sue and get plenty. You just can’t kill someone....especially when they’re defenseless.
Does it make any sense that any one would break into a house via a chimney?
Just break a window, {and I'd shoot you} and come on in.
The idiot didnât know that fireplace chimneys have changed since âThe Night Before Christmasâ was written.
Lets see what possible Jury members say.
Jurist #1 ASA Vet ... Sorry, No payout, and you get to pay the attorney fees for the Home Owners Insurance Company.
Next Jurist.
Is this sarcasm or insanity?
Lighting a fire was insane....

Agree....... But the story indicates the family didn’t know the deceased was in the chimney.
Apparently he was stuck in the chimney for almost a day. Strange to say the least.
You better be able to prove he was a mute.
What a way to get a chimney sweep.
He peobably was keeping quiet UNTIL the fire was lit.
Best. Story. Ever.
“Legal theory”, well there is no real standard they could sue over. However, they could try a civil case stating that the owners should have covered the chimney with something to keep “kids” from fall into them.
I suppose anything is possible. If the burglar had fallen off the roof and died of a broken neck, should the homeowners be sued because they didn't have netting around their house to catch a falling kid? As I said, an age of insanity.
No payout.
Here in my State only 6 jurors in a civil case. You’re number 2. Need 4 more.
What they probably didn't realize is that he was really stuck.... and thought the fire would bring him down....
He dies...of course they're going to lie through their teeth. They have the advantage. Dead men tell no tales.
I would agree with you except we’re talking about California...
They would have to prove the home owner knew he was there before they started the fire.
The only witnesses are the residents of the home.
By definition, a burglar uses stealth to enter a home, that stealth would prevent the home owner from knowing the man was in the fireplace until after the fire was started.
Unless someone in the home is an idiot and admitted they knew he was there, they cannot be sued for starting a fire in their own fireplace.
I would bet money the burglar removed a screen or cover to enter the chimney.
A modern chimney is a tight fit. He probably passed out long before any fire was set.
>> It just doesnât make any sense to me <<
Stupid homeowner meets stupid burglar?
Maybe that’s all we need to know.
