Agree. Prosecutors and judges who object to the death penalty on religious grounds do not have to prosecute or hear those cases. They recuse themselves and the work is given to those who have no moral objections.
This is also true of people who have moral objections to combat, and should also be true for abortion or gay marriage.
Congress is suppose to make laws not the courts.
I wonder what Kennedy imagines ultimately happened to Hitler’s judges?
Since the Supremes didn’t create new law, just which laws are these individuals not in compliance with?
Supreme Court justices should resign if they have political convictions as he and the others do.

He is not far off the mark. We are getting primed and set up for a nazi or soviet like government with very little freedoms. The only thing preventing it is the millions of firearms out there in the hands of the masses. If they were not there we would already be East Germany circa 1977.
They are working on the gun issue with each mass shooting, hoping they can garner enough public support for the outright murder of Americans who refuse to submit to a gun ban.
