The Washington Post is reporting that President Obama is considering an end run around Congress to make some changes to existing gun laws. In particular, he is considering “imposing new background-check requirements for buyers who purchase weapons from high-volume gun dealers.”
Under Obama’s proposed executive fiat, dealers who sell more than an arbitrary number of guns will need to obtain a license from the ATF and perform background checks on consumers.
This latest overreach comes on the heels of a tragic shooting at the gun-free Umpqua Community College. Obama has asked his team to scrub what kinds of authorities do we have to enforce the laws that we have in place more effectively to keep guns out of the hands of criminals.
We are hopeful we can find a way to do this, said one senior administration official, who noted that lawyers were still working through details to ensure that the rule could pass legal muster. Its a lot more clear today than it was a year ago how to work this out.
So what’s on Obama’s executive action agenda that will presumably stop the gun violence?
“The proposed executive action aims to impose background checks on individuals who buy from dealers who sell a significant number of guns each year. The current federal statute dictates that those who are ‘engaged in the business’ of dealing firearms need to obtain a federal license and, therefore, conduct background checks but exempts anyone ‘who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms.’ ”
We now know that the Oregon shooter purchased his weapons legally and passed a background check to do so. “All were traced to a federal firearms dealer,” said Celinez Nunez, an agent with the US Bureau of Alcohol, Tobacco, Firearms and Explosives.
The Sandy Hook shooter stole weapons from his mother.
The Aurora movie theater shooter bought his guns legally and passed a background check.
The man who shot former congresswoman and gun-control activist Gabrielle Giffords passed a background check.
The man who shot two Virgina journalists live on the air passed a background check.
So, what is the purpose of Obama’s proposed expanded background checks? Do we have any evidence that expanding the definition of a gun dealer will decrease gun violence?
This is just another useless, empty gesture that inconveniences law-abiding citizens and doesn’t deter criminals and lunatics.
Tighten your seatbelts and stock up on guns, ammo, food and water.
The blizzard of criminal and unconstitutional hell that will pour on us from Obama between now and January 2017 will make the last 7 years of his crap seem like a walk down a garden path.
Why doesn’t he just do it instead of all this pussyfooting around?!
He is a drama King/Queen.
I’m hoping with the new republican leadership impeachment IS on the table.
To slow down and stop the flow of guns into the hands of those with the wrong political views.
How long before the federal government defines the act of being anti-big government and holding strong patriotic and constitutional views as a potentially dangerous mental condition?
The Obama administration has already classified patriots and military vets as potential terroristss.
Where pray tell can I find a gun dealer who sells guns publicly without a FFL and does not process NICS checks on their customers ? Or, is this ATF license an add on to the FFL license dealers current license ?
Who are they gonna impeach? Certainly not the lyin’ king. That would just prove that the gopE is racist and wants all blacks to die. Besides, it’s about 6 and 1/2 years too late now. And the gopE is more concerned about getting yeb boosh the nomination for the next (s)election. They’ve been “in control” of both house and senate since last year and pffft! Nuthin’. Pretty disappointing.
Simple choice.
You can wind up like the Jews in Germany in the 30’s and 40’s or you can go out and buy a gun and try to keep yourself out of a government camp.
“Before a standing army can rule, the people must be disarmed; as they are in almost every kingdom in Europe.
The supreme power in America cannot enforce unjust laws by the sword; because the whole body of the people are armed, and constitute a force superior to any band of regular troops that can be, on any pretense, raised in the United States.”
~ Noah Webster
It won't do anything to stop crime, but it's hardly useless.
I’m not an expert, but have bought guns in the past (legally)....but I did find this quite interesting:
As important, if the president decides to bypass the legislative process and act unilaterally to limit guns, he will be courting a political disaster. The NRA is not some fringe group of irrational gun nuts seeking to take advantage of the Sandy Hook tragedy to drum up members and donations, as the mainstream media and even the president have implied. Rather, it represents the serious concerns of millions of law-abiding Americans, from both parties, who value their Second Amendment right to gun ownership for self-defense, sport, and protection against disorder or government tyranny, as the Framers originally intended. The president once derisively talked about bitter small-town residents cling[ing] to guns or religion. Well, nothing would make people cling harder to their guns than an effort to ban them by executive fiat. And the courts, most likely, would support them.

So my question is this: Can Congress over rule the President’s executive order because there are already laws on the books that cover what he wants to do in his executive order or can Congress de-fund his executive order?
Without food and water, guns are useless. In Webster's time, the people controlled access to food and water.
You can't.
Those are just typical Obama exaggerations and outright lies to justify making background checks mandatory for person to person sales.
Person to person sales are the democrat invented "Gun Show Loophole" that drives liberals into apoplectic fits.
The thought of citizens being free to make private deals or to do pretty much anything else without government control is just too much for them to live with.
There are ways to control gun violence. A mandatory death penalty with limited appeal for the use of a gun in a crime would go a long way to deter gun crime. Ending the idiocy of gun free zones would also help stop free shooting sprees.
Arming “protectors” such as teachers, guards, managers or others overseeing children will send a message.
If we are serious about stopping mass shootings we can take simple, effective steps to do so.
Clearly progressives have a vested interest in perpetuating mass shootings to further their gun confiscation agenda. They are not interested in protection. They want control, and not of the criminal class but of the average citizen who will oppose their tyrannical policies.
Don't underestimate the power of technocrats. The thing to watch is the rules made by the agencies in order to enforce it. The government likes to shift the burden of proof onto the people. How are they going to know you've sold 50 or more guns? Every time you buy a gun, you'll have to pay a processing fee that will be arbitrarily set by whatever agency, fill out tons of paper work, register your gun with the ATF, and endure random audits on your stock. Perhaps it'll work it's way into an insurance requirement. Whole industries will be birthed to make sure every gun owner is in compliance. You and I won't be able to afford it. Viola! Fewer guns in the private hands. Buying a gun will become extremely expensive and invasive. This will be backdoor national registry.
Don't doubt me on this. It looks so meaningless, innocuous, and grandstanding, but the Left has had thousands of smarmy little Pajama Boys working on this for a long time. They've used the agencies to great affect since forever.
Because it is illegal.
They’ll do that just by the process they impose. Patriots won’t like enduring the rectal exam for buying a gun.
