Since there has been much evasion and obfuscation about Hillary Rodham Clintons e-mail use, it seems appropriate to step back and simply review what we know in light of the law. Its also instructive to compare Clintons situation to arguably the most famous case of our time related to the improper handling of classified materials, namely, the case of Gen. David Petraeus.
Instead of turning his journals so-called black books over to the Defense Department or CIA when he left either of those organizations, Petraeus kept them at his home an unsecure location and provided them to his paramour/biographer, Paula Broadwell, at another private residence. (None of the classified information in the black books was used in his biography.)
On April 23, Petraeus pled guilty to a single misdemeanor charge of unauthorized removal and retention of classified documents or materials under 18 USC §1924. Many in the intelligence community were outraged at the perceived slap on the wrist he received, at a time when the Justice Department was seeking very strong penalties against lesser officials for leaks to the media.
According to the law, there are five elements that must be met for a violation of the statute, and they can all be found in section (a) of the statute: (1) Whoever, being an officer, employee, contractor, or consultant of the United States, and, (2) by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, (3) knowingly removes such documents or materials (4) without authority and (5) with the intent to retain such documents or materials at an unauthorized location [shall be guilty of this offense].

Another attack on Hillary, you woman hater, you!
The fact that she is still allowed by the media and the political establishment to run as a candidate for the Presidency tells you everything about how far we have fallen. Everything. It doesn’t matter what her party affiliation is, and I would feel the same if she was a Republican, Independent, or anyone. I don’t condemn her as a person, or judge her as a person. However, as a candidate who by choice is running for the highest individual government position in our nation, she is just not qualified by virtue of her own actions. That the media would cover for her is an indictment of their own values, and an abdication of the incredibly important role they’ve been entrusted with in society.
If America was still a nation of laws, Clinton would have been in prison a long time ago. Just like she wanted to do to Nixon.
LOL - Maybe iCarly will rush to her defense!
She’s a prime democrat. The law will do nothing.
Those on the left really are different. Politics is their religion. All that matters is winning. It was the Republicans who told Nixon he had to leave or they would vote to impeach and then convict. The Democrats would never do that. We saw that with Clinton. Ironically, had Gore taken over for an impeached/convicted Clinton, he would have run as an incumbent and probably won.
Our side would not re-elect a Marion Barry after he got out of prison. We would not vote to put an impeached federal judge in the House. We would not keep someone in the House who was so stupid that he thinks extra troops on Guam would cause the whole island to capsize.
We our side demonstrates, we don’t use foul language, destroy property, or crap or urinate in the street. Our side does not damage cars if they have a bumper sticker with which we disagree.
Well said and true. Thank you.
Since we know there was Top Secret data on her unsecured server, we also know the following:
Somebody downloaded Top Secret data from the Secure system.
They then stripped the Classification markings from the data.
They then uploaded this data to an unsecured system.
Then they e-mailed the data to Hillary.
Each of these is a Felony.
Nobody would do this without direction from Hillary.
Hillary and the facilitating party belong in jail.
Thanks for putting this out, Doug. Mucho appreciation.
Good catch, thanks for posting. The piece reveals, simply, that she broke the law. Will the law win?
The next battle in the war on wommenez.
And, no she will not be prosecuted.
Yea she broke the law, but at this point what difference does it make..
She needs to be prosecuted but the government will not prosecute her. Barack Caitlin Obama will never prosecute her. She was part of his team. She was running the state department like it was her own personal property and she had no problem selling government secrets to foreign governments. They did it while Bill was president and after, so who’s going to stop her.
So who cares that she broke the law. These are federal crimes and they need to be brought before a federal judge. If nobody brings them to the courts then it’s as if nothing happens. Barack Caitlin Obama will protect her and there are enough morons in this country that if you give them a free phone and more free stuff they will vote for her. She is not going to give up because she might still become the president.
This used to be a country of laws but Caitlin Obama has made it clear that he is not going to do anything about it.
Barack Caitlin Obama and Hillary Clinton belong in prison but they are just laughing at the entire country. Obama is ruining this country and he does not care.
"What difference does it make?"
” Obama is ruining this country and he does not care.”
Obama cares, believe me. He really, really cares, and he’s lovin’ it.
I'm fed up. Can't we honestly start discussing a true solution to the stupidity of Democrats? We've got people, loose, on the streets, who actually STILL believes the Clintons are just being picked on.
I'd suggest exporting them all to Pluto, since the costs involved will still be less than the costs of the destruction of this country. We'll let them figure out how to survive after they get there. After all, they are the smartest people in the room...
It is impossible to break the law if you have a (D) after your name
EVERYONE knows she broke the law for God sake.
The QUESTION remains... "when will SOMEONE step up and DO something about it?
I believe we all know the answer to that.
