Davis says she won't stop deputy clerks from issuing same-sex marriage licenses

Rowan County Clerk Kim Davis says she will not personally issue any marriage licenses although she will not interfere with other deputy clerks in her office if they choose to do so.

Davis addressed the media around 7:45 a.m. outside the courthouse before resuming her duties after being jailed last week by Judge David Bunning.

During her remarks, Davis said she was in a difficult spot: "it's my conscience or my job."

"I don't want to have this conflict. I don't want to be in the spotlight. And I certainly don't want to be a whipping post," Davis said, reading from a hand-written statement outside the courthouse where she works. "I am no hero. I'm just a person that's been transformed by the grace of God, who wants to work, be with my family. I just want to serve my neighbors quietly without violating my conscience."

Davis says any same-sex licenses issued by her office will not have her name or title. She says she does not know if they will be legal.

Since Davis says she will not try to stop deputy clerks in her office from issuing marriage licenses to same-sex couples, she appears to be in compliance with Judge Bunning's order.

Like I've said...."WELL PAID" Dem Operative...but she sure got us Christian Republicans in a frenzy.

Why wasn't Hillary defending her? Sanders? O'Malley??

For the record...There is no such thing as a gay marriage. We've all heard the phrase...it's just a piece of paper.

Davis says any same-sex licenses issued by her office will not have her name or title. She says she does not know if they will be legal.

The first sentence is what she and others were pushing for since before the SCOTUS decision.

The second sentence is the consequence of having a lawless judiciary.

And I am both appalled and saddened by the number of freepers who refuse to recognize when someone does the right thing. Kim Davis gets less credit for standing up for her beliefs than Chuck Schumer gets for standing up for Israel on this forum.

Think about that, folks.

There is a video on the page with her complete statement.
She clearly communicates the conflict between the state law and the scotus ruling.

She got what she wanted; her name is not on them.

I'm betting she takes retirement (that old conscience ya know)....and a big fat pension with it.

Any attorney is setting her up for a lawsuit...based on....no other clerk who has refused to issue licenses has gone to jail....why me?? Harrassment....female....hurt her feelings....duress....humiliation...

One doesn't have to be "Religious" to know there is no such thing as gay marriage. It's a life style...their choice...leave us folks who don't believe in it, out of it.

Finally, The Supreme Court is broken....going way back to "killing babies" is a right.

Yep. Such consistency is completely congruous with the z’rule of law” we used to cherish in this country.

Good article until it talks about the appeal more on the appeal here - it was about due process.

The media has focused on same sex licenses, but Kim was not issuing licenses to anyone. In the WSJ article a judge in Alabama said as much - below.

This fact has been left out of media coverage on this issue.

Other State Officials Say No to Same-Sex Marriage

http://www.wsj.com/articles/other-state-officials-say-no-to-same-sex-marriage-1442161531

In Alabama, about a half-dozen county probate judges, who oversee the issuance of marriage licenses, aren’t providing them to any couples, said Greg Norris, the Monroe County probate judge and president of the Alabama Probate Judges Association.

Among them is Nick Williams, the Washington County probate judge. He said he stopped issuing licenses immediately after the U.S. Supreme Court ruling in June that legalized same-sex marriage—a decision he said he considers “ill-advised” and “invalid,” because marriage is a state issue.

“By not issuing licenses to anyone, I’m not discriminating against anyone,” Judge Williams said.

As long as this was all about her and her rights, instead of about her sworn duties and THE LAW, and the way our constitutional republic is supposed to function, with checks and balances, this whole thing was doomed. I have good friends that I respect who say, “blame the lawyers,” and I do. But she is a public official, and she is responsible for everything done in her name by her lawyers, and for every public document that proceeds from the office she was elected and sworn to fill.

And there were six clerks available, but the homo-couple went to the ONE PERSON who would refuse, thereby provoking the confrontation - mission accomplished.

All that you mentioned was, I imagine, discussed as the payoff...

It was very “enlightening” shall we say, that the Governor stepped in and altered the marriage certificate to say ‘person 1’ & ‘person 2’ to accomodate the sodies, but he will not step in to accommodate Kim Davis’s religious (Christian) beliefs - claims he doesn’t have the authority. I’m not sure the Governor has the authority to change anything as he did (the hypocrite), but the legislature can .... we’ll see what they do when they are back in session. SHE is following KY law as it is written, to the letter. One more thing ... my contention has been and continues to be that if Kim Davis were a Muslim, she would have been accommodated.

Except that Ms Davis would not allow any of her deputy clerks to issue the licenses, since her name appeared on all of them. There were zero clerks available until she went to jail. Then they started issuing the licenses without her name on them - which is what will apparently continue to happen.

She says the licenses without her name are not valid; the Attorney General of KY says they are. That’s a court fight for another day, I guess.

Who knew we would have a ‘religious test’ to be elected and/or work in this country.

It was issue them or join her in jail. They chose to issue them.

Curious, under what law is her office issuing licenses? The one they were using was specific to one male and one female where female lived etc. It was struck down as discriminatory.

On a side note, since courts cannot make law only legislative bodies can make law, and most State authorizing marriage laws had normal Heterosexual language throughout them like KY - by striking the law granting authority for states to issue normal marriage licenses - are all licences issued since the opinion invalid for States that have not passed new Mirage Laws to go with the Court’s fiction?

“But the licenses “will not be issued or authorized by me,” Davis said. “Any license will not have my name, my title or my authority on it ... instead, it will say it’s issued pursuant to a “court order.”
