MOREHEAD, Kentucky When the Rowan County clerk's office opens at 8 a.m. ET Monday, Kim Davis will have a decision to make.
In her absence, her subordinates have been issuing marriage licenses to same-sex couples. Does she stop them? If so, how? Call a staff meeting? Fire them?
Or stay silent?
"We hope Kim Davis will follow the law and obey court orders," said Amber Duke, a spokeswoman for the American Civil Liberties Union of Kentucky. "If she doesn't, our attorneys will meet and decide our next action."
Even Davis' lawyers at Liberty Counsel, the Florida-based group that has been representing her, haven't offered specifics on what she plans to do.
"Kim Davis is the only person that can decide what Kim Davis will do," said one of her attorneys, Harry Mihet. "She has told the court and everyone else that she will not under any circumstances violate her conscience and the core of who she is."
The ongoing saga has captivated the country and personified the battle between same-sex marriage and religious freedom.
As the Rowan County clerk, Davis refused to issue marriage licenses to anyone after the U.S. Supreme Court legalized same-sex marriage in June. The ACLU sued on behalf of several couples who were denied licenses, and earlier this month a federal judge sent Davis to jail for refusing to comply with federal law.

“Planting Peace,” a non-profit organization, erected a new billboard in Morehead reading, “Dear Kim Davis, the fact that you can’t sell your daughter for three goats and a cow means we’ve already redefined marriage.”
The organization’s director of operations, Davis Hammet, told CBS News that he’s trying to send a message that will inspire Davis to think the situation through and “to recognize that she is acting as an agent of the government. And if she can’t fulfill that duty, to needs to resign.”
After five days behind bars, the 49-year-old Davis was released from jail last week. Her lawyer says a solution is still possible if they remove Davis’ name, title and authority from the marriage licenses.

I think the main sore point is HER NAME ON THE FORM.
She wants it taken out of it. If that can be done, she won’t have any other objections at all.
Set up a separate clerk office window for marriage ‘licenses”. Close the window. Kepp on with the rest of clerk office duties (just like before). Peeps can go to another county to get a license (or fly to Vegas).

It is ONE OF her functions, but among others, The duties of the county clerk fall into the general categories of clerical duties of the fiscal court:
issuing and registering,
recording and keeping various legal records,
registering and purging voter rolls,
conducting election duties, and
conducting tax duties.
A county clerk who chooses to serve in this capacity must attend all meetings of the fiscal court and keep a complete
record of its proceedings, with an index.

It has to be noted that when Kim Davis took office, she swore to uphold the laws of Kentucky and at that time, the laws regarding marriage PROHIBITS same-sex marriage.
The laws are still in the books and have not been repealed.
The law was complicated by the Supreme Court’s decision which happened when Kentucky’s legislature was ( and still is not ) in session.

The ACLU didn’t care when Gov. Moonbeam didn’t follow the law.
So NOW we are supposed to follow laws that were created by judicial decree after countless scofflaw cases happened?

Yes. The law still only allows for male-female marriage.
The legislature needs to amend the law or double down.
Not issuing any licenses is a good faith concession to the other side.

At least three licenses issued in Rowan County were altered so they did not include the name of the County Clerk, Kim Davis. Instead “Rowan County” was entered as the name of the County Clerk.
“Rowan County” is not the name of the Rowan County County Clerk. Listing “Rowan County” as the name of the County Clerk is a violation KRS 402.100(1)(c), 402.110
Persons issuing these licenses have committed multiple misdemeanors. KRS 402.990
As long as her name is not on the document, she probably won’t interfere. Her issue has always been that her name had to be on the form authorizing the marriage.

She has made it very clear. She will not have her name on any certificate related to a mirage of sodomy marriage. And she will not allow anyone under her authority to support in any manner the mirage of sodomy marriage.

What law??? It's not a law, it's a court ruling. Not a law!
Correct. There is no law that authorizes her to issue a license for gays. All the laws currently written only authorize her to issue license for a man and a woman.
We have a made a terrible mistake in our past in allowing judges to “write” laws. Once a law struck down, it should have had to be re-written to be constitutional.
Why is it so hard for people to understand that 5!idiots on the Supreme Court unconstitutionally gave themselves power the constitution expressly forbids and struck down a law. They did not right a new law to replace it and neither base Kentucky. She should just say that there is no marriage law in Kentucky and fire most of the staff because they are not needed until Kentucky rolls over like a dog a passes a new one.
