It is ONE OF her functions, but among others, The duties of the county clerk fall into the general categories of clerical duties of the fiscal court:

issuing and registering,

recording and keeping various legal records,

registering and purging voter rolls,

conducting election duties, and

conducting tax duties.

A county clerk who chooses to serve in this capacity must attend all meetings of the fiscal court and keep a complete
record of its proceedings, with an index.

It has to be noted that when Kim Davis took office, she swore to uphold the laws of Kentucky and at that time, the laws regarding marriage PROHIBITS same-sex marriage.

The laws are still in the books and have not been repealed.

The law was complicated by the Supreme Court’s decision which happened when Kentucky’s legislature was ( and still is not ) in session.

Yes. The law still only allows for male-female marriage.

The legislature needs to amend the law or double down.

Not issuing any licenses is a good faith concession to the other side.
