I think the spine issue was pre-existing and I doubt it is reasonable to expect the city anywhere to be liable while arresting people to know all their past medical conditions.

That was just a rumor that was going around for a few days when it first happened, there was no actual evidence for that. He had surgery a while before the incident and some people just assumed it was for something related without any real info.
