DENVER, CO, August 28, 2015 (LifeSiteNews) -- While gay "marriage" activists claimed that the Supreme Court's marriage decision wouldn't open the door to polygamy, five people from the show "Sister Wives" want the 10th Circuit Court to disagree.
"This case is about criminalization of consensual relations and there are 21st century cases rather than 19th century cases," said attorney Jonathan Turley in a filing. "It is clear that states can no longer use criminal codes to coerce or punish those who choose to live in consensual but unpopular unions."
In a case that was filed in 2011, "Sister Wives" star Kody Brown and his four "wives" have argued that Utah's ban on polygamy violates their civil rights. The five adults and their 17 children moved to Las Vegas after the launch of "Sister Wives" because they faced prosecution in Utah.
Utah lost the case at a federal court last year, and appealed to the 10th Circuit Court.
Brown isn't the first polygamist to cite the Supreme Court's decision to justify polygamy. Earlier this year, Nathan Collier -- who has appeared on "Sister Wives" -- and his two "wives," Victoria and Christine, sued the state of Montana. "You can't have this without polygamy," he said.

I still don’t understand why they even have to go to court after the gay marriage ruling. Since the Supreme Court ruled that anything goes, why aren’t the other perversions not included?

I agree with their reasoning that if marriage is no longer just between one man and one woman because of a nebulous ‘right to dignity’ then there is no legal argument left to justify criminalizing committed polygamous relationships among consenting adults.
The hypocrisy of the whole thing is that men have had mistresses and even second families forever. And it’s been accepted. Even President Grover Cleveland had a mistress and a second family and that was okay.
I remember a poly wife saying once (paraphrased): “If someone asks me who I am to him and I tell them I’m his mistress they’re okay with it. But if I say I’m his second wife they call the police.”
Funny, isn’t it, that it’s the committed relationship that causes problems, not the licentious and promiscuous relationship.
You are part of it whether you like it or not. I did not say everyone is to blame. But we all live in the same country. If you are a citizen of the USG (United States of Gomorrah), you are part of the “we” in the sense of official position. The good side lost and the evil side won. The black robed rulers have declared it the law of the land.
Why can’t a rich person marry his/her inheritors? Because then as spouses they would be exempt from the death tax. That ought to make the liberals’ heads explode because the elimination of inherited wealth is one of the planks of the communist manifesto.

You are right, especially if it were a same sex wedding. Or as older people who can no longer have children, the problem with being a relative is moot. There is no existing reason for the state to disallow it.

I didn’t say don’t fight it, either. But as of now, it is what it is. Of the zillion presidential candidates, only a small handful have promised to fight it. Everyone slept through the best time to fight. By all means let’s keep fighting. But it will not help to deny reality.
