The man blamed for causing the wreck that killed KFOR Sports Director Bob Barry, Jr. was charged Tuesday with causing an accident while operating a vehicle without a state drivers license.
Gustavo Gutierrez, 26, of Bethany, was also charged with a felony count of possession of cocaine.
The driving offense carries a punishment of up to five years in prison and a $5,000 fine.
The drug possession carries a punishment of up to 10 years in prison and a $5,000 fine.
The charges could be amended at a later date.

Furrowing his brow when the manslaughter charge was read, 26-year-old Gustavo Gutierrez didnt say a word aside from his name in his first appearance before a judge on Monday.
Gutierrez is accused of causing the deadly accident over the weekend on N. May Ave. near Quail Springs Mall.

McKenzie says because police allegedly found a small amount of cocaine inside the suspects wallet, which is a felony offense, Gutierrez could ultimately be charged with murder.
Committing a felony during an accident that causes a death can result in a charge of murder in the second-degree, said McKenzie.
Bob Barry, Jr. had been driving his motorized scooter southbound in the left lane on May Ave.
The suspects car was in the right lane next to him.
Police say Gutierrez made an illegal U-turn, trying to turn back to the north.
That illegal turn caused Bobby to crash into the drivers side of the car.

Bobby was transported to the hospital where he was pronounced dead.
Its a very sad situation, said McKenzie.
In addition to manslaughter, Gutierrez is being held on possible charges of causing an accident without a valid license, making an illegal U-turn and drug possession.
Judge Russell Hall set the suspects bond at $18,500 but Gutierrez has an immigration hold, meaning he had been in the country illegally and wouldnt be set free even if he was able to post bond.

Bob Barry Junior was a local guy, maybe with a somewhat privileged story, but everyone liked him, and from times I'd heard him on certain sports radio shows, I'd say conservative in the way he lived and raised his family, if that matters.
To answer your question murder is murder... but don't bet anything you're not willing to lose on the NYT et al jumping all over this story.
KFOR, as you know, is the NBC affiliate in Oklahoma City... don't expect NBC to jump all over it either. What they're saying behind closed doors is "tough hsit, no story", because that's the kind of people they are.

First inclination is to say “ship him back to the hellhole he came from.”
But realistically, he would be back here breaking more laws in 6-8 months.
Lock him up for the maximum time, sentences to run consecutively on separate charges.
By the time he gets out, maybe we have that wall built and he won’t be able to kill anymore American civilians.

On Sunday, U.S. Immigration and Customs Enforcement (ICE) placed a detainer with Oklahoma County on Gutierrez from Mexico, following his arrest on criminal charges. ICE officials confirmed that Gutierrez had been voluntarily returned to Mexico three times, twice in 2010, and once in 2013.

So, he was “returned voluntarily to Mexico 3 times”? This time, send him back in a coffin. Guarantee ya he won’t be making a 4th trip up here to kill more U.S. citizens. What, U.S. citizens have to be sitting ducks for every illegal piece of scum that won’t stay where they belong, and ICE won’t apprehend?
