A federal judge on Tuesday ordered a California city to release police video that shows officers fatally shooting an unarmed man in 2013 after police mistook him and others for robbery suspects.
The decision against Gardena, a city south of Los Angeles, was appealed and a higher court late Tuesday issued a stay on the order until arguments can be heard.
The video shows Gardena police fatally shooting Ricardo Diaz-Zeferino, who was out looking for his brother's stolen bicycle with two others early on July 2, 2013, when the three men were detained by police responding to the call of the theft, which was reported to officers as a robbery, authorities said.

Wow, you have to see the video. The victims were looking for the bicycle they reported stolen, and the cops shoot them. The cops murdered him in cold blood while surrounding him front, back and side. Inexcusable. If the one cop who couldn’t see the victim’s other hand had shown discretion, the other cops who could see both hands would have had him covered if there was any possible reaching for any weapon (which he did not have). He simply lowered his arms after having raised his hands over his head. Not a good enough reason to murder an innocent man who had no guilt in anything. Family got a $4 million plus settlement.
No officers were harmed in the making of this video.

Yes, the police have become cowardly murderers. These three look like kids on bikes, not a threat.

I think the cops were completely wrong in this case. But drunk, drugged and disobeying legal police orders is a fairly reliable route to a short life.
They also did not have him “surrounded front, back and side.”
The cops were around him in at most a 90 degree arc.
As I’ve said many times on FR, I think American cops are WAY too ready to resort to firing their weapons. But that doesn’t mean the kid shot in this video didn’t behave stupidly.
I have myself been in this exact situation. Except I was sober and not stupid. Or at least I did not behave stupidly.
Had I reacted as the kid did, I’d almost certainly have been killed. In that case, the cops were looking for an escaped murderer, who since his escape had murdered several people, including a cop. Had I even twitched wrong, my brains would have been all over the magazine rack at the convenience store.
The escapee was killed a couple of days later in a shootout with cops. Or at least that’s what the cops said. This was long before dashcams, much less bodycams. It was common back then to shoot a guy and then produce a dropgun to justify the shooting. Or at least there was very little other than personal ethics to prevent a cop from doing so.
Curious when the word went out that kids on bikes are by definition not a threat.
Just last week, I think, they had a group of very young kids, including a 12 year old, that murdered two people in a preplanned ambush, if I remember correctly.
Dead guy was 34, not a kid.

The idiot suspect in the dark shirt reached for his pockets or waistband not 1, not 2, not 3, but 4 times while being ordered to keep his hands up.
It was a borderline shooting at worst. No rational person could say it was in “cold blood”.
If the moron had kept his hands up like his 2 friends everybody would have gone home safely.

He clearly didn't do what he was ordered but he wasn't reaching for anything. Not even once other then his hat. He was fired on when he had both palms of his hands up.

Being stoned out of your mind with little or no English skills, in the early AM and being stopped by police looking for a dangerous felon, is a deadly situation.....deadlier if you can’t follow directions and make furtive movements.....

The little illegal alien, suspect in an “armed and dangerous” search, ignored the police commands and made what can reasonably be interpreted as a furtive movement towards his waistband while covering this movement with his hat.
You can argue he committed suicide by cop, or that the laws of nature finally caught up to this moron, but the implication that the cops did any thing other than protect themselves from a suspected “armed and dangerous” suspect is bogus....
Have you ever been caught up in such a police search? I have and I can tell you that I was all ears and obeyed every command until they could determine I wasn’t the droid they were looking for! (They were searching for an active shooter driving on the freeway who shot over 20 people after driving along side of them on the highway.)

Doesn't matter if someone could be a potential threat. They have to be an actual imminent threat to justify shooting them.
I suspect that the video left out that important piece of information because your previous correspondent dragged that anecdotal tidbit into the argument from his own personal experience, which has absolutely nothing to do with the current thread.
