Waco Biker Challenges Judge's Gag Order in Criminal Case

The only biker to sue in connection with a mass arrest following a deadly shootout at a Texas restaurant argued in a petition filed Wednesday that he was unfairly slapped with a gag order after publicly criticizing how the investigation has been handled.

Matthew Clendennen, one of 177 people arrested after the May 17 shootout in Waco in which nine people were killed, said the order in the state's criminal case against him is unconstitutional and outside the court's jurisdiction because he has not been indicted. The order prevents attorneys, witnesses and law enforcement officers involved in the criminal case from discussing it with the media.

McLennan County District Attorney Abel Reyna, among those named in Clendennen's federal civil rights suit, requested the gag order Tuesday during a hearing in Clendennen's criminal case. District court judge Matt Johnson, Reyna's former law partner, granted the order, saying he was acting to prevent pretrial publicity from influencing potential jurors.

Johnson and Reyna's onetime partnership extends back until at least 2001, when Johnson joined the Reyna & Reyna law firm, which was owned by Reyna's father, former McLennan County district attorney and state appeals court judge Felipe Reyna.

According to state campaign records, Reyna and Reed each donated $1,000 to Johnson's 2006 campaign, the maximum each was allowed to contribute under state law governing judicial campaigns.

Exactly. Defence handgun loads are usually hollow-points intended to expand and do as much damage as possible by shredding internal organs. Jacketed rifle rounds are designed to penetrate and exit causing a slower bleedout due to reduced organ damage.

You need to repeat that a few dozen times to get people to understand the real argument here.

I assure you it HAS been repeated. We have a tiny little claque on these threads who simply do not care about the real argument.

Actually, It is the Constitutional process and that thing called Due Process of Law, that thing that goes back to Roman Law and The Law of Moses. That is what has, or used to have a strong following on this forum. Unfortunately, it is not as strong as it once was, because, those who worship those in authority have infiltrated its ranks.

If the police had been justified in their actions, the video that they themselves shot of the incident would have been made available to every media outlet in the region within 24 hours. And the autopsy reports within a week[7 days]. Nor would everyone within the area have been arrested on trumped up charges.

That is my bone of contention. Others have similar points of contention.

Wearing gang patches in public is more than a simple clothing choice...if it were the Bandidos & Cossacks wouldn't have gotten into a shooting war over who had the right to wear the Texas patch on their back.

There is also the fact that not all the bikers present at Twin Peaks on May 17th were arrested, including members of a number of well known motorcycle clubs.

So your premise that there was an abuse of law based on choice of clothing is patently false, something which has been pointed out to you multiple times.

And you still seem to be incapable of comprehending that a “Fat Mexican” t-shirt is not the same as a back patch and does not indicate ‘gang membership”.

If they had only arrested those with back patches, I wouldn’t have as much difficulty with law enforcement’s mass arrest: I would be able to see at least a clear indication of ‘gang’ membership.

In addition to local and state police, the federal Alcohol, Tobacco, Firearms and Explosives (ATF) was also on the scene, according to its official twitter account.

So, yes, BATF was there. What we do not know is how they were deployed and what they did. WE do know (per Chief Brent Stroman) that Waco PD were sitting in their vehicles when the first shots were fired. He also stated that HIS men fired 12 rounds.

I have seen no comment from BATF regarding their positioning or engagement.

That is what I heard also. And it would not surprise me if the FBI wasn’t there also. I can’t picture the FBI missing a chance to kill someone or maybe getting to burn some children alive.

Well ... I've kept count, and in real numbers among FReepers who've commented one way or another (not neutral), for every ONE FReeper who believes that all bikers are "trash" and the cops just took out the garbage on 177 people, there are more than TWO who think the cops were way out of line and trying to cover their asses at the expense of law-abiding motorcycle enthusiasts -- to wit, all-American BIKERS, of which there are millions across our great fruited plain.

The consensus supports the "biker trash" -- 164 individuals on FR that I've identified, versus 77 identified who support the cops.

FReepers are on balance smarter than average.

There are something like 5 posters that post as fast as they can to support the way “justice” is being served in Waco. Imo - a vocal minority, not a consensus.

Actually and happily, not just in your opinion, but in point of FACT according to crunched numbers that anyone can duplicate by going through dozens of threads and keeping a list, as I have done -- the ratio is about 2.13 to 1 against the dupes who believe the "biker trash" narrative. We are more than twice their size in real numbers, as opposed to number of posts.

I do it on issues of importance because I want to know the real picture here on FR rather than a false one presented by a minority that posts five times more than the majority. And that is what has happened here -- a minority has exaggerated its presence to present a false picture of the consensus.

The jackboot lickers are actually a very small minority. They are just loud and repetitive. Makes it seem like they are more numerous than they are.
