Finding that the state had exceeded its constitutional authority, a Lucas County judge ruled Friday that Toledos only remaining abortion clinic may keep its doors open.
Common Pleas Judge Myron Duhart found that Capital Care Network may continue to operate its West Toledo clinic, concluding that Ohios law requiring abortion clinics to have transfer agreements with local hospitals was unconstitutional.

The 30-page ruling, which reversed a previous decision by the Ohio Department of Health to close the clinic, was hailed as a victory by abortion-rights advocates and attorneys for Capital Care.
Theyre open for business. Theyre licensed, and they have a transfer agreement, Cincinnati attorney Jennifer Branch said of Capital Cares West Sylvania Avenue clinic. Theyre good to go. The women in Toledo have a choice now. Without Capital Care, the women in Toledo are left with driving to Michigan, Cleveland, or Columbus.
Dan Tierney, a spokesman for Ohio Attorney General Mike DeWine, said Judge Duharts decision would be appealed to the Ohio 6th District Court of Appeals. Mr. DeWine did not have additional comments on the ruling, he said.

Lucas County is a little pocket of whacko Democrat activists
Under Ohio law, ambulatory surgical centers (which include abortion mills) must have a doctor on staff who has admission privileges with a local hospital. Many abortionists do not have such privileges. When that is the case, abortionists have found doctors who will “substitute” for them should an abortion participant need hospital care. This results in a variance if approved by the Ohio Department of Health.
