From what I understand, the perp couldn’t pass a Background check, so his father got him the gun for his 21st birthday. A background check cannot prevent a person from giving that gun to a family member, friend, or anyone else..The background check system worked, the father decided to be an idiot and give the gun to his whack job pop pilling son

Not unless he had a drug conviction recently, and from what I hear he hadn't been convicted on the April charge yet. Arrest != conviction.
