OVERTON, TX (KTRK) -- Police in Texas shut down a lemonade stand run by two little girls. They said it was illegal.
Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father's Day present. They wanted to take him to Splash Kingdom.
They had been selling lemonade and kettle corn for an hour - and made about $25 - when officers showed up and told them they need a $150 permit to sell their lemonade.
Texas House Bill 970, or the Texas Baker's Bill, does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since lemonade needs to be refrigerated to prevent bacteria growth, police said they needed an inspection from the health department and a permit to sell it.
"It is a lemonade stand, but they also have a permit that they are required to get," Overton Police Chief Clyde Carter said.

Little girl: The city just wants me to pay them $150 don't they? And it really has nothing at all to do with health reasons right?
Officer Fife: Well you little brat!! How dare you question my authoritay! Just for that I'm going to have to cuff you and take you downtown!
“It is a lemonade stand, but they also have a permit that they are required to get,” Overton Police Chief Clyde Carter said, “besides, these effin little criminals should be glad we didn’t send SWAT! We coulda raided them with an armored personnel carrier and shot that m-f-ing dog of theirs!”
That was worth saying twice!
We are no longer the “Land of the free and the home of the brave”.
Mostly, we have become the land of the serfs.
We’ve had too many Yankees moving down here to turn us into a blue state!
Must be a conspiracy of some kind—LOOL!
That’s what happened to Texas—too damn many of you damn Yankees moved down here-—LOL!
I’m a 7th generation Texan, and have watched this happen with a lot of uneasiness.
> That was worth saying twice!
Oh i thought regulations were put in place to protect people not generate revenue...Silly me.../s

The names hardly seem like those of recent transplants from New Jersey or some such bastion of Yankeedom. The local representatives to both houses of the Legislature and Congress are Republicans.
A quick Google search shows this story to have reached media outlets as far away as New York and London. It looks like the local Boss Hoggs are about to be hit by a media firestorm they don't want. To Texas officials who get overzealous in enforcing laws, remember the fate of Tulia.
Ever hear of Nuremburg? There were trials there.....
Hassling little girls is a great way to help run out the clock till that sweet, sweet retirement pension kicks in. Certainly beats doing police work.
you omitted the most important name of all
Freepers want to know
Who called the cops?
I drive though Overton every week and if they have a cop he must be very undercover. Guess I better be on the lookout for Barnie Fife.
Actually, the acid in the lemons and the sugar will inhibit bacterial growth. Both have been used as preservatives for eons. (think pickles and jams) Even if that weren't the case, you have a 4 hour window before anything starts growing anyway. So, rather than someone who actually knows about health issues, we have a grump who needed to kick a couple of little girls around.
I’d support the muslin selling goat as well.
A blue county-city-district, no doubt.
Ha!
If I moved to Texas, I would be another conservative added to the millions already there in The Lone Star State.
My politics are to the right of the late, great North Carolina senator Jesse Helms.
Here in Maine, the Maine House and Senate just passed Constitutional Carry, and our ultra-conservative governor Paul LePage said he will sign it. The Bloomturd idiots tried to stop it, but they failed.
You are the exception to the rule! Come on down!
It’s already being “not received well” the city wonkers are in full retreat mode and pointing fingers at each other!!!
Another big win for “the law is the law” crowd.
WooHoo! The public is safe from lemonade stands!
The horror!
