This makes no sense. If Klayman filed the suit a couple of days ago, even assuming he served the defendants on the very day he filed, they would not yet have had time to file either an Answer to the Complaint or a Motion to Dismiss it. Things just don’t happen that quickly in any court. Is there a link to the Order? Or a case number. We can search it at PACER.

Thanks. I saw that after my earlier post. The order is docket #40, so the article has to be wrong about when the suit was filed, wasn’t a few days ago. I haven’t taken time to look at PACER to look up the docket to see when it was filed and the intervening activity, i.e., the Answer, motions filed, the scheduling order, who the attorneys representing the defendants are, etc.
Interesting the conference is set for exactly one year to the day before our next POTUS will be inaugurated. THO, I would bet there’s gonna be a lot of rescheduling before it’s all said and done. RICO cases are very hard to win, so let’s see what Klayman can do.
