Dude flipped cop off to test his 1st amendment rights to freedom of expression = not a good idea
Saratoga Springs police released the camera they had confiscated on Saturday, showing officer Nathan Baker pepper spraying a man sitting in his car before grabbing the mans arm and twisting it out the window. Officer Baker claimed he was arresting Adam Rupeka for disorderly conduct.
Rupeka had flipped him off while driving past him. And while the New York statute for disorderly conduct includes a line about making an obscene gesture, the 2nd U.S. Circuit Court of Appeals, which encompasses New York, ruled that flipping cops off is protected by the Constitution.

He wasn’t ‘testing’ his test his first amendment rights he was being an assh*le. Shall we assume liberal lowlife?
So there’s an unlawful stop, two assaults under color of authority (pepper spray, arm twisting), theft (camera), as well as official oppression under color of authority (prevention of lawful filming, prevention of lawful expression). Cops who do this should be facing multiple criminal charges, but until they do, it would appear we are living in a police state.

That cop is out of control, like so many cops today he is indulging himself, on tax payer’s time, while on duty.
A lot of labor and costs get tied up in this arrest and the towing of the car, the court time, the time the arresting cop is off the streets and at the station, and so on.
Even without a law suit and lawyers, the cop just wasted a small ta dollar fortune indulging his personal emotions.
I once gave the finger to a President Bill Clinton convoy that was passing by as he was leaving LAX in Los Angeles. What retribution did I deserve?
The cop should have shot his ass.
The cop should be fired.
Chances are this peace officer got his badge to compensate for doubts concerning his masculinity. I doubt it as well.
Well, if flipping off one cop justifies pepper spray, and you flipped off the President (and a whole bunch of cops in his motorcade), then I guess you should consider yourself lucky you didn't get shot!
So lets say some asshole gives you the middle finger.
Do you believe that you therefore have the right to spray OC in his face, twist his arm and take his camera from him without his permission?
Do those actions not constitute assault, assault with a weapon, battery and theft?
