A federal court has decided that the National Security Agencys (NSA) bulk, warrantless collection of millions of Americans phone records is illegal.
The decision from the Second Circuit Court of Appeals on Wednesday represents the second major court victory for opponents of the NSA, after a lower court decision called the program nearly unconstitutional six months ago.
The phone records program exceeds the scope of what Congress has authorized, Judge Gerard Lynch wrote on behalf of the three-judge panel. The court did not examine the constitutionality of the surveillance program.

Regardless of any appeal, the courts will never know their decision is being ignored. Nothing will change.
Now they’ll erase the records from their hard drives, but they will turn up later on a backup disk, or some DVDs, that tey ‘forgot’ to shred.

Interesting that the 3 judge panel was a Clinton apointee and 2 Obama apointees.
Tyrant Obama will simply use his authority as commander in chief as stated in the US Constitution to conduct the bulk collection and analysis, and neither the court nor Congress will have the backbone to say "NO" to him.
If Obama will not stop it, he should be impeached and removed from Office ASAP.
No broad scope public cameras should be legal.
I have my own version of the "Do not call" list. I use a multi station/handset Panasonic cordless phone system that has a Block List. Get a T-marketer call? Add the number to the Block list. It rings once then hangs up on the caller. Easy peasy, lemon squeezy.

Call data records do not include content; that is, the actual voice interaction between the callers, SMS messaging, or any electronic exchanges between two human beings.
Via link analysis, these records are used to tip-off other, more intrusive means. More intrusive means require a FISA court approval from a domestic investigative entity if the subject is a US person. NSA does not have the authority to collect content at will and yes, it is strictly enforced. See EO 12333 (signed by President Reagan) and all the supporting law behind it.
NSA is not a law enforcement entity. They are a DoD organization required to follow POSSE COMITATUS. If they discover a threat to domestic interests, they pass it to Dept. of Justice who is by law authorized to act. If Dept. of Justice does not act, it is not NSA’a fault.
NSA has done great things in the defense of the Nation than many will ever know. They can not publicize successes at risk of tipping off bad guys on how they do their work.
This action plays into the hands of jihadists and others who wish ill to our country as well as to manipulate ignorant and/or misinformed civil libertarians. It should not be celebrated.
When a government is in power that is counter to your cherished beliefs, the NSA will be there to assist them. Better to dismantle it now than to risk a system of control the world has never seen before.
So we should just trust them? On what basis?
