The chairman of the House Select Committee on Benghazi said he might take former Secretary of State Hillary Rodham Clinton at her word if she swears under oath that she’s turned over any relevant documents he’s seeking.
“If she were, under some theory, able to say, ‘yes, I can promise you under penalty of perjury you have every single document you’re entitled to,’ that would probably shut off that line of inquiry,” Rep. Trey Gowdy, South Carolina Republican, told USA Today’s “Capital Download.”
“There may be other questions about the security of the server or why you gave this person clintonemail dot com address but you didn’t give this person — those are all separate questions,” he added. “I just need to make sure that the public record is complete.”
Mrs. Clinton said in March that she exclusively used a private email address while serving as the nation’s top diplomat largely out of convenience. She turned over about 30,000 emails she deemed work-related to the State Department in late 2014 — nearly two years after leaving office — and deleted the rest, also wiping clean a private server and declining to turn the server over to an independent party.

Maybe he’s setting a perjury trap. If she swears, and he has the evidence to show she lied then she could end up in jail.
I think he has her in a catch-22.

If she refuses to swear she turned over all relevant emails and she destroyed the server the legal presumption is cause for discovery and consequently she is guilty of tampering with evidence. If she swears under oath there were no more emails of relevance she admits that there were more emails just none relevant but this contradicts her representation who denied any more emails existed period in the other cases.
“The public doesn’t have to follow this logic. All they have to ask is why is Hillary unwilling to swear under oath what she insists is the truth and expects us to believe. Her attempt to demonize the Gowdy investigation collapses as well since he is being more than reasonable and gracious with his offer of respecting her word.
“She can’t agree or disagree with Gowdy - either way she hangs for prejury and/or tampering with evidence.”

He said he’d take her at her word if she just swears it’s all above reproach. She has already said it is and will do so again. Then Gowdy will have to accept it or look like a lying fool playing word games. Just like you.
Then all she can do is evade and "forget", in which case Gowdy's offer just makes her look more guilty.
That was my initial thought, too.
It will be interesting to see her response. She has no idea what the emails of others might provide, and she might be very worried about some of her “donors” providing evidence against her, particularly if the polls aren’t favorable.
But, what do I know. It is hard for the honest to comprehend the mind of the dishonest.
Exactly. This is not giving her a pass this is forcing her hand. If she says under oath that she turned everything over that is relevant and he has something she didn't turn over, or something turns up which is quite likely if they exist, then she's cooked.
Brilliant move by Gowdy, and Hillary knows it. If she takes the bait Hillary swears herself into a perjury trap, and if she refuses to give such a sworn statement it will confirm that she has withheld evidence.

Gowdy could have all 30,000 deleted emails detailing the most horrendous unimaginable crimes by Hillary and she would still walk away.
Gowdy is sold out and he is letting her walk. No special lawyer tricks.
He will get her to say “i am a true patriot and did my very best and anyone can take a few words out of context if they want” he will say good enough for me, we need to cross the aisle and reconcile.

As any litigator knows, if you have evidence you dont let her explain.
If you don’t have evidence, you dont let her explain. You NEVER invite her to come say she’s innocent. Never!
If you have damning evidence you present it. You don’t invite her to squirm out with grand statements about her innocence and goodwill. You cannot predict or control what she does ffs.

Gowdy was a sussessful prosecutor so forgive me if I believe he might no a little about working a suspect.
