I believe that very question is before the Supreme Court right now.

According to Justice Kagan, it has to do with whether Clerk B should still edit a draft Clerk C wrote because Clerk A was too busy to write it.

According to Justice Kennedy, if people might be hurt by the Court correcting the government's violation of the law, then the law should not be followed.

According to Freeper Talisker, we are so screwed.

Clerk A is an inexperienced junior with six months on the job. Clerk A is still in training and needs oversight of their work.

Clerk C is a 20 year veteran, and nobody needs to check their work.
