No there not. The Geneva Convention says that if a soldier identifies with a country, wears a uniform and identification (tags) then the are covered by the convention otherwise THEY ARE NOT.

However, the Geneva Convention is the terms of how a war shall be conducted, and how soldiers are treated. Terrorists are not soldiers, Mr. McCain. They only thing Bush did wrong (with regard to the terrorists) was not to execute them summarily after torturing them for information.

Moving them to Gitmo and giving them special diets while using “proper Koran handling procedures” was a travesty.

Waterboard them, torture them by any other means necessary, test the information provided in the field, then hang them, preferably from the lower deck of the Verrazano-Narrows bridge as a warning to others.
